If they are old enough to understand what is going on, yes of course. Otherwise, I think they should have an adversary to represent their interests.

Yes, if they are old enough to understand and I think maybe in Judge's qts or is that lawful? if not it should be as a court room is much too scarey for them.

In most cases the judge will talk to the child in chambers, but some will speak with them in open court.

Judge Robert M.Foster will do neither for your children.

Each state has its own process. There will be court assigned counselors that will talk to the children. They will observe how both of you are with the children. The counselors will make suggestions to the judge. When it comes to the children the judge should do what is best for the children, but that is not always the case.
If he wants to talk with children the parents have no say.

If the child wants something to be heard by the judge and they aren't listening to the child. Get a Guardian ad Litem. They can advice you on what to do.

yes, i think children should be able to talk to the judge. they know what they want and they are a lot smarter than most people give them credit for. besides in the end it is about keeping the child happy and doing whats best for them.

My daughter talked to a Judge in Michigan when she was 9 years old. This was an exceptional case and it was absolutely necessary.

If it is Absolutely Necessary....for the most part I don't think they should. What is going on in the household between 2 adults have nothing to do with the child. If it is about custody (maybe, if 1 parent is physically abusive or moving out of the state). These kids already have enough to deal with when it comes to their peers, why give them your own adult burden. Easier say then done; but, just dont argue and abuse each other in front of your children then there will be no need for them to spaek to a judge in reference to "Your" marriage & or Divorce. JMO

That's a tough one because sometimes one parent will poison the children against the other. They should be heard, however, the tone of the divorce should be considered.
This didn't happen to me, but I have seen good fathers loosing the ability to see their children because of an evil, vindictive wife. I'm sure it goes the other way too.
