If a person refuses to file taxes because they know they are due a refund and it will be confiscated for a federal debt, can they get in trouble for that?

can tell you from my military experience when the gov. owes you they drag thier feet but when you owe them they wanted it yesterday!! go figure

Well at first they tried to make me pay a fine! and also added interest, this was resolved a year late when they issued me a check

Heck, I know how the military works, and you are sooo right.
This is the deal... my estranged husband owes AAFES over $5000. He owes me over $6000 in support. He did not file taxes this year, nor does he plan to file next year because he knows he won't see his refund. None of this is just going to "go away" as long as he doesn't file taxes.
But, is it really tax evasion if you are expecting a refund??

A failure to file Tax Return is a criminal offense. If I remember correctly for my days working for a law firm, the punishment is up to 1 year in jail and $25,000 fine...(or something like that)...Expectation of a return is NOT an excuse for not filing it...

He just spent 30 days in jail and got his azz kicked by an 18 year old (having surgery tomorrow to repair some of the damage). And all I want is for him to file his taxes to avoid any MORE problems. Heck, he should be picked up again any day now for "nonsupport" but I am not pushing that. Just want to be able to advise him on the law. Something he can look up himself and verify if he wishes.

heres how i understand it..if you don't file it can be considered "tax evasion" which is against the law,and an arrestable offense.owing the money is not a crime and they can't put you in jail for owing it.they can if they can prove your hiding money or assets to "avoid" paying what you owe .my advice would be to talk to one of the tax relief people you see ads for on tv constantly.IRS counselors also can be used but my experience with them is they don't really have a clue of what their doing.GOOD LUCK,QUE

que... it depends what they owe money for. Not paying your court ordered child support is a crime and he CAN be arrested for owing that money and not paying it.
But, the not filing part is what is annoying me.

whether you owe or are owed it is a criminal offense not to file. the irs has strict guidelines and they dont screw around. they will take what they want and/or throw your ass in jail.

Cute, I was a Child Support Enforcement Investigator here in NY
I would think your state is also adament re: Child Support.
If he Refused to file his Tax Return, and you can prove his reason,
He can be held liable for it.
You sound like you dont want to give him any problems, but how much
are your children going without?
I had several cases like this this. In NY if you were to file for
Child Support, or file a Violation Petition against him, you could
state the Tax Deal and the Judge could make a condition that he file
or face contempt of court charges. This could be a very long stay in Jail,
this would also be generated to the IRS, your Sopport will work with you,
and no fees for their assistance.
I can only advise what goes on in NY. But you should contact the support
office and get their suggestions.
Good luck with this, don't feel guilty getting what is yours.
