Eugenic Sterilization Laws

While some eugenicists privately supported practices such as euthanasia or even genocide, legally-mandated sterilization was the most radical policy supported by the American eugenics movement. A number of American physicians performed sterilizations even before the surgery was legally approved, though no reliable accounting of the practice exists prior to passage of sterilization laws. Indiana enacted the first law allowing sterilization on eugenic grounds in 1907, with Connecticut following soon after. Despite these early statutes, sterilization did not gain widespread popular approval until the late 1920s.
Advocacy in favor of sterilization was one of Harry Laughlin’s first major projects at the Eugenics Record Office. In 1914, he published a Model Eugenical Sterilization Law that proposed to authorize sterilization of the "socially inadequate" – people supported in institutions or "maintained wholly or in part by public expense. The law encompassed the "feebleminded, insane, criminalistic, epileptic, inebriate, diseased, blind, deaf; deformed; and dependent" – including "orphans, ne'er-do-wells, tramps, the homeless and paupers." By the time the Model Law was published in 1914, twelve states had enacted sterilization laws.
By 1924, approximately 3,000 people had been involuntarily sterilized in America; the vast majority (2,500) in California. That year Virginia passed a Eugenical Sterilization Act based on Laughlin’s Model Law. It was adopted as part of a cost-saving strategy to relieve the tax burden in a state where public facilities for the "insane" and "feebleminded" had experienced rapid growth. The law was also written to protect physicians who performed sterilizing operations from malpractice lawsuits. Virginia’s law asserted that "heredity plays an important part in the transmission of insanity, idiocy, imbecility, epilepsy and crime…" It focused on "defective persons" whose reproduction represented "a menace to society."
Carrie Buck, a seventeen-year-old girl from Charlottesville, Virginia, was picked as the first person to be sterilized. Carrie had a child, but was not married. Her mother Emma was already a resident at an asylum, the Virginia Colony for the Epileptic and the Feebleminded. Officials at the Virginia Colony said that Carrie and her mother shared the hereditary traits of "feeblemindedness" and sexually promiscuity. To those who believed that such traits were genetically transmitted, Carrie fit the law’s description as a "probable potential parent of socially inadequate offspring." A legal challenge was arranged on Carrie’s behalf to test the constitutional validity of the law.
At her trial, several witnesses offered evidence of Carrie’s inherited "defects" and those of her mother Emma. Colony Superintendent Dr. Albert Priddy testified that Emma Buck had "a record of immorality, prostitution, untruthfulness and syphilis." His opinion of the Buck family more generally was: "These people belong to the shiftless, ignorant, and worthless class of anti-social whites of the South." Although Harry Laughlin never met Carrie, he sent a written deposition echoing Priddy’s conclusions about Carrie’s "feeblemind-edness" and "moral delinquency."
Sociologist Arthur Estabrook, of the Eugenics Record Office, traveled to Virginia to testify against Carrie. He and a Red Cross nurse examined Carrie’s baby Vivian and concluded that she was "below average" and "not quite normal." Relying on these comments, the judge concluded that Carrie should be sterilized to prevent the birth of other "defective" children.
The decision was appealed to United States Supreme Court. Justice Oliver Wendell Holmes Jr., himself a student of eugenics, wrote the formal opinion for the Court in the case of Buck v. Bell (1927). His opinion repeated the "facts" in Carrie’s case, concluding that a "deficient" mother, daughter, and granddaughter justified the need for sterilization. The decision includes the now infamous words: It is better for all the world, if instead of waiting to execute degenerate offspring for crime or to let them starve for their imbecility, society can prevent those who are manifestly unfit from continuing their kind…Three generations of imbeciles are enough.
Recent scholarship has shown that Carrie Buck’s sterilization was based on a false "diagnosis" and her defense lawyer conspired with the lawyer for the Virginia Colony to guarantee that the sterilization law would be upheld in court. Carrie’s illegitimate child was not the result of promiscuity; she had been raped by a relative of her foster parents. School records also prove that Vivian was not "feebleminded." Her 1st grade report card showed that Vivian was a solid "B" student, received an "A" in deportment, and had been on the honor roll.
Nevertheless, Buck v. Bell supplied a precedent for the eventual sterilization of approximately 8,300 Virginians. Borrowing from Laughlin’s Model Law, the German Nazi government adopted a law in 1933 that provided the legal basis for sterilizing more than 350,000 people. Laughlin proudly published a translation of the German Law for the Prevention of Defective Progeny in The Eugenical News. In 1936, Laughlin was awarded an honorary degree from the University of Heidelberg as a tribute for his work in "the science of racial cleansing."
The second Supreme Court case generated by the eugenics movement tested a 1935 Oklahoma law that prescribed involuntary sexual sterilization for repeat criminals. Jack Skinner was chosen to test the law’s constitutionality. He was a three-time felon, guilty of stealing chickens at age nineteen, and convicted twice in later years for armed robbery. By the time his case was struck down by the U.S. Supreme Court, in 1942 some 13 states had laws specifically permitting sterilization of criminals.
The opinion striking down the sterilization law in the case of Skinner v. Oklahoma (1942) was written by Justice William O. Douglas. He highlighted the inequity of Oklahoma's law by noting that a three-time chicken thief could be sterilized while a three-time embezzler could not. Said Douglas: "We have not the slightest basis for inferring that … the inheritability of criminal traits follows the neat legal distinctions which the law has marked between those two offenses."
Despite the Skinner case, sterilization of people in institutions for the mentally ill and mentally retarded continued through the mid-1970's. At one time or another, 33 states had statutes under which more than 60,000 Americans endured involuntary sterilization. The Buck v. Bell precedent allowing sterilization of the so-called "feebleminded" has never been overruled.

When the white supremacist Council of Conservative Citizens (CCC) held its annual national conference June 1 and 2 at a Holiday Inn in Greenville, S.C., James Edwards was the golden boy of the hate group's proceedings.
Edwards, 27, is the host of "The Political Cesspool," a shamelessly white nationalist radio talk show that's broadcast for two hours every weeknight from a studio near Memphis, Tenn., where Edwards grew up and still lives.
"The Political Cesspool" in the past two years has become the primary radio nexus of hate in America. Its sponsors include the CCC and the Institute for Historical Review, a leading Holocaust denial organization. Its guest roster for 2007 reads like a "Who's Who" of the radical racist right. CCC leader Gordon Lee Baum, Holocaust denier Mark Weber, Canadian white supremacist Paul Fromm, American Renaissance editor Jared Taylor, neo-Nazi activist April Gaede, anti-Semitic professor Kevin MacDonald, Stormfront webmaster Jamie Kelso and League of the South president Michael Hill have all been favorably interviewed on the "Political Cesspool" this year, along with former Klan leader and neo-Nazi David Duke, the show's most frequent celebrity racist guest, who has logged three appearances.
"I have known Dr. Duke for a number of years and have found him to be a Christian man above reproach," Edwards says on the "Cesspool" website. "Time and again, he has gone out of his way to help me, asking for nothing in return."

Edwards is quite a bit younger than the majority of CCC members who attended the South Carolina conference. Many of those members' involvement in the white supremacist movement dates back to the White Citizens Councils that were formed to oppose school desegregation and the civil rights movement and were later reincarnated as the CCC. Edwards sat with his wife at a table near the back of the conference hall, engaging in conversation with a nearly constant stream of admirers who looked twice his age or more. They slapped his back and shook his hand and congratulated him not only on the success of "Political Cesspool" — which is tailored for a southern, neo-Confederate, white nationalist audience — but also his recent triumphs in smoothly injecting white nationalist ideology into national mainstream media discussions of race relations and crime in America.
Edwards arrived at the hate group conference just three days after his third primetime appearance on CNN in the previous two months. "Crime and violence follow African-Americans wherever they go," he said in his April 4 CNN debut, a panel debate on "self-segregation" hosted by Paula Zahn. "And if you think that is racist, then spend some time on the mean streets of south Memphis."
Zahn, who initially identified Edwards to CNN viewers as merely a "radio talk show host" from Memphis, invited him back on May 21 for a "Paula Zahn Now" episode titled "The Changing Face of America."
"Why not celebrate the diversity?" Zahn asked him in one exchange.
"My primary interest is to protect and safeguard my family," Edwards replied. "Whites are in for the fight of their lives. America is becoming balkanized. We are being robbed of having a future in the very nation our ancestors carved from the wilderness."
David Duke, who calls Edwards his "favorite radio patriot," gave the "Cesspool" host's CNN appearances a glowing online review: "He delivered a powerful performance, stuck to his guns and didn't back down as he articulated an unapologetically conservative viewpoint regarding race relations."
'Heathen Savages'
Edwards began garnering similar accolades from his elders on the radical right last year as the "Cesspool" gained a larger and larger audience. (Although the show is broadcast only regionally on the airwaves, anyone can listen to it on the Internet.) "James is a bundle of energy and dedication who is deeply concerned about the genocide against European-Americans," white nationalist Bob Whitaker stated online after appearing on the show. "He is also wiser than many of the older members of our movement. … He sticks with legitimate complaints that gentiles have and our fear of the genocide of immigration and intermarriage that respectable conservatives all advocate. The Political Cesspool is one of the first major steps toward making our perfectly legitimate and generally felt concerns — the ones that are presently denounced as heresy, racism and hate — the mainstream."
The "Cesspool" host is a rising star of the white nationalist movement because he's articulate, charming and equally at ease in a television studio, behind a radio microphone and standing in front of a crowd. He was a specially invited guest speaker at the CCC conference. His topic: "Creating Your Own Media." CCC National Field Coordinator Bill Lord told a "Martin Luther Coon" joke in his introduction of Edwards. Lord and other longtime CCC members casually dropped racial epithets at the conference, but Edwards carefully avoided using such crudely derogatory language, as he always does when speaking in public, on the airwaves or to the media. Edwards allies himself with hate group leaders who call black people "n**gers," but he doesn't drop the N-bomb himself. Instead he speaks in the more or less polished code of a suit-and-tie racist, calling blacks "heathen savages," "subhumans," and "black animals," exclusively in the context of discussing violent black-on-white crime.
His audience of about 150 at the CCC conference included Jared Taylor, whose magazine specializes in race "studies," and Don Black, the former Alabama grand dragon of the Knights of the Ku Klux Klan and founder of Stormfront, the largest racist forum on the Internet.
Edwards began by quoting Mississippi civil rights activist Fanny Lou Hamer, telling the crowd that he is "sick and tired of being sick and tired" when it comes to reverse discrimination against white people. He described "Political Cesspool" as "unabashedly pro-white" and detailed the show's early success in rallying Memphis whites to "defend" the gravesite of Confederate cavalry general Nathan Bedford Forrest, the first national leader of the original KKK. The gravesite was the subject of a protest in August 2005 led by the Rev. Al Sharpton, at which about 200 whites squared off against a few dozen black Sharpton supporters.
"Sharpton denigrated the general's gravesite with that kind of rabble there," Edwards said. He then boasted of the lavish all-expenses-paid treatment afforded him by CNN, including, he said, fine hotels and limousine rides. Edwards finished by announcing that "as a result of listener demand, support from station ownership and a surge of interest from the recent CNN exposure," beginning the following week "Political Cesspool" would expand from one hour per weeknight to two.
He received a standing ovation.

I remember when all of the whites on here supported Cliven Bundy of Nevada, and his stand against the BLF.
He turned out to be a good ol' racist in the end. And all of his white support on talk radio and here just quietly went away, hoping we all would forget and never mention it.

@Hiram As awful as it sounds many people are severly mentally uncapable of taking care of themselves, why let them get pregnant over and over to only have abortions. In many cases the young women want the baby. Its like a real live "doll" to play with. The baby is then starved to death and beaten. What's more humane? Read about the world famous Menniger Hospital here in Topeka. My dad told us horror stories of what happened to those people put there. Many were not crazy at all. They were unruly teenagers who's parents put them there. There are unmarked graves on the grounds. When Dr. Menniger took over the hospital the atrocities stopped. The old buildings are there still. An ominous reminder of what went on in the tunnels that connected the buildings. There used to be warnings put out via radio when my dad was younger about "walkaways". Parents told to bring their kids in and lock their doors. Most of those who got away went to the railroad tracks and laid on the tracks to die. Orhers fell trying to jump on the train. They'd take the patients in the tunnels stripped naked and turn fire hoses on them. Topeka state hospital before it was Mennigers. Closed down and all those people on the street with no way to survive. So what's more Humane?

During his sophomore year in high school, Cody Beck finally got fed up with hearing homophobic cracks. If his classmates thought being gay was weird (Beck was openly bisexual), he had a confession that would blow their minds. He told them he is sexually attracted to dogs and horses.
"I just couldn't keep it in anymore," Beck says. "Just for the hell of it, I figured I'd throw it out there and have them make fun of me even more." Which they did. An 18-year-old from Arizona who graduated from high school this past year, Beck says classmates taunted him by calling him "Bestiality Dude."
Being a "zoophile" in modern American society, Beck says, is "like being gay in the 1950s. You feel like you have to hide, that if you say it out loud, people will look at you like a freak."
Now Beck believes he and other members of this minority sexual orientation, who often call themselves "zoos," can follow the same path as the gay rights movement. Most researchers believe 2 to 8 percent of the population harbors forbidden desires toward animals, and Beck hopes this minority group can begin appealing to the open-minded for acceptance.
But if those like Beck are to make the same gains as gays, it's apparent they will have to do so without the help of gay rights groups, which so far want nothing to do with a zoophile movement. What's more, they will have to wage battle with well-funded and politically connected animal-protection activists.

I read all of hirams long posts on this thread so far (I probably will not read more of them if he posts more though... they aren't interesting enough to keep following) and the posts themselves were interesting.
1: The eugenics movement DID in fact have some legitimate thinking behind it. If we could PREVENT the births of people that would have to be upheld by society, then we could prevent having to pay for it. Unfortunately, in practice, it simply didn't work... and how could it? There is no formula for who will be indigent. The likelihood that further eugenic laws will be passed in our country is highly remote. It was tried, and it failed miserably.
2: Pedophilia, in and of itself, is not illegal. Promoting it is also not illegal. Beating someone up, refusing to give them service, or other such nonsense should be generally discouraged. PRACTICING it on the other hand... that needs to be stopped. There are many that would like to see relationships be like what they are in India, Cambodia, the Middle East, and central Africa... places where a 30 year old man marrying an 8 - 12 year old girl is not uncommon. I will continue working to make sure that such efforts fail. Most pedophiles point to such places and suggest that it should be ok because those places do it. The US also used to endorse it with age of consent laws being as low as 7 (prior to 1898). They stopped and rightly so. Still, much of the rest of the world still openly allows such practices. So for you to proclaim this is a "white" thing makes you a moron... seeing as how the whites are the ones that began the push for pedophilia to be illegal in the first place.

Eugenic Sterilization Laws

While some eugenicists privately supported practices such as euthanasia or even genocide, legally-mandated sterilization was the most radical policy supported by the American eugenics movement. A number of American physicians performed sterilizations even before the surgery was legally approved, though no reliable accounting of the practice exists prior to passage of sterilization laws. Indiana enacted the first law allowing sterilization on eugenic grounds in 1907, with Connecticut following soon after. Despite these early statutes, sterilization did not gain widespread popular approval until the late 1920s.
Advocacy in favor of sterilization was one of Harry Laughlin’s first major projects at the Eugenics Record Office. In 1914, he published a Model Eugenical Sterilization Law that proposed to authorize sterilization of the "socially inadequate" – people supported in institutions or "maintained wholly or in part by public expense. The law encompassed the "feebleminded, insane, criminalistic, epileptic, inebriate, diseased, blind, deaf; deformed; and dependent" – including "orphans, ne'er-do-wells, tramps, the homeless and paupers." By the time the Model Law was published in 1914, twelve states had enacted sterilization laws.
By 1924, approximately 3,000 people had been involuntarily sterilized in America; the vast majority (2,500) in California. That year Virginia passed a Eugenical Sterilization Act based on Laughlin’s Model Law. It was adopted as part of a cost-saving strategy to relieve the tax burden in a state where public facilities for the "insane" and "feebleminded" had experienced rapid growth. The law was also written to protect physicians who performed sterilizing operations from malpractice lawsuits. Virginia’s law asserted that "heredity plays an important part in the transmission of insanity, idiocy, imbecility, epilepsy and crime…" It focused on "defective persons" whose reproduction represented "a menace to society."
Carrie Buck, a seventeen-year-old girl from Charlottesville, Virginia, was picked as the first person to be sterilized. Carrie had a child, but was not married. Her mother Emma was already a resident at an asylum, the Virginia Colony for the Epileptic and the Feebleminded. Officials at the Virginia Colony said that Carrie and her mother shared the hereditary traits of "feeblemindedness" and sexually promiscuity. To those who believed that such traits were genetically transmitted, Carrie fit the law’s description as a "probable potential parent of socially inadequate offspring." A legal challenge was arranged on Carrie’s behalf to test the constitutional validity of the law.
At her trial, several witnesses offered evidence of Carrie’s inherited "defects" and those of her mother Emma. Colony Superintendent Dr. Albert Priddy testified that Emma Buck had "a record of immorality, prostitution, untruthfulness and syphilis." His opinion of the Buck family more generally was: "These people belong to the shiftless, ignorant, and worthless class of anti-social whites of the South." Although Harry Laughlin never met Carrie, he sent a written deposition echoing Priddy’s conclusions about Carrie’s "feeblemind-edness" and "moral delinquency."
Sociologist Arthur Estabrook, of the Eugenics Record Office, traveled to Virginia to testify against Carrie. He and a Red Cross nurse examined Carrie’s baby Vivian and concluded that she was "below average" and "not quite normal." Relying on these comments, the judge concluded that Carrie should be sterilized to prevent the birth of other "defective" children.
The decision was appealed to United States Supreme Court. Justice Oliver Wendell Holmes Jr., himself a student of eugenics, wrote the formal opinion for the Court in the case of Buck v. Bell (1927). His opinion repeated the "facts" in Carrie’s case, concluding that a "deficient" mother, daughter, and granddaughter justified the need for sterilization. The decision includes the now infamous words: It is better for all the world, if instead of waiting to execute degenerate offspring for crime or to let them starve for their imbecility, society can prevent those who are manifestly unfit from continuing their kind…Three generations of imbeciles are enough.
Recent scholarship has shown that Carrie Buck’s sterilization was based on a false "diagnosis" and her defense lawyer conspired with the lawyer for the Virginia Colony to guarantee that the sterilization law would be upheld in court. Carrie’s illegitimate child was not the result of promiscuity; she had been raped by a relative of her foster parents. School records also prove that Vivian was not "feebleminded." Her 1st grade report card showed that Vivian was a solid "B" student, received an "A" in deportment, and had been on the honor roll.
Nevertheless, Buck v. Bell supplied a precedent for the eventual sterilization of approximately 8,300 Virginians. Borrowing from Laughlin’s Model Law, the German Nazi government adopted a law in 1933 that provided the legal basis for sterilizing more than 350,000 people. Laughlin proudly published a translation of the German Law for the Prevention of Defective Progeny in The Eugenical News. In 1936, Laughlin was awarded an honorary degree from the University of Heidelberg as a tribute for his work in "the science of racial cleansing."
The second Supreme Court case generated by the eugenics movement tested a 1935 Oklahoma law that prescribed involuntary sexual sterilization for repeat criminals. Jack Skinner was chosen to test the law’s constitutionality. He was a three-time felon, guilty of stealing chickens at age nineteen, and convicted twice in later years for armed robbery. By the time his case was struck down by the U.S. Supreme Court, in 1942 some 13 states had laws specifically permitting sterilization of criminals.
The opinion striking down the sterilization law in the case of Skinner v. Oklahoma (1942) was written by Justice William O. Douglas. He highlighted the inequity of Oklahoma's law by noting that a three-time chicken thief could be sterilized while a three-time embezzler could not. Said Douglas: "We have not the slightest basis for inferring that … the inheritability of criminal traits follows the neat legal distinctions which the law has marked between those two offenses."
Despite the Skinner case, sterilization of people in institutions for the mentally ill and mentally retarded continued through the mid-1970's. At one time or another, 33 states had statutes under which more than 60,000 Americans endured involuntary sterilization. The Buck v. Bell precedent allowing sterilization of the so-called "feebleminded" has never been overruled.

What Eugenicists did was extremely screwed up. Applying that to all criminals would have been an extreme atrocity. Had that been done to me, I would have taken up arms.
