There have been persistent rumors over the past several months regarding a potential federal investigation into Jane Sanders, wife of independent Vermont Sen. Bernie Sanders, regarding a questionable land deal she oversaw during her 2004-2011 tenure in charge of the now-defunct Burlington College in Vermont.
Though both the Department of Justice and FBI declined to officially confirm or deny the investigation, several local media sources have reported that an ongoing investigation does indeed exist, according to The Daily Caller.
Central to the investigation are allegations that Sanders may have engaged in bank fraud in order to obtain a multi-million-dollar loan to purchase land for an expansion of the school, by misrepresenting to the bank the amount of pledges she had obtained on the school’s behalf to match a portion of the loan she was requesting.
According to Cornell Law, the felony crime of bank fraud is statutorily covered by 18 U.S. Code Sec. 1344, which reads: “Whoever knowingly executes, or attempts to execute, a scheme or artifice — (1) to defraud a financial institution; or (2) to obtain any of the moneys, funds, credits, assets, securities, or other property owned by, or under the custody or control of, a financial institution, by means of false or fraudulent pretenses, representations, or promises,” etc.
Conviction under this statute can result in a fine of up to $1 million and a sentence of up to 30 years in federal prison.
The existence of the investigation was first reported by VTDigger, which utilized state public records requests to obtain emails that showed federal investigators were in contact with several individuals affiliated with the bankrupt and closed school, with at least one individual even receiving a subpoena.
Independent Vermont media outlet Seven Days further confirmed the existence of an investigation via interviews with at least two former college officials, both of whom stated that they had been contacted by the FBI within the past few weeks and that the 2010 purchase of 32 acres of land from the Catholic diocese was the focus of their investigation.
The issue was initially raised by Vermont Republican Party co-chair Brady Toensing, who requested the U.S. attorney for Vermont to investigate “apparent federal bank fraud” at the school, according to VPR. Though Toensing hasn’t been contacted by either the U.S. attorney’s office or the FBI, it would seem that his request elicited a reaction.
Though all of the various media outlets contacted Sen. Sanders and his wife for comment, their requests were declined, save for VPR, which received a statement from Sen. Sanders’ former campaign manager Jeff Weaver, who stated, “Jane has not been contacted by the FBI or any other authority and only knows as much as news reports indicate.”
