The unlawful surveillance appears to have been a massive abuse of the government’s foreign-intelligence-collection authority, carried out for the purpose of monitoring the communications of Americans in the United States. While aware that it was going on for an extensive period of time, the administration failed to disclose its unlawful surveillance of Americans until late October 2016, when the administration was winding down and the NSA needed to meet a court deadline in order to renew various surveillance authorities under the Foreign Intelligence Surveillance Act (FISA).
The administration’s stonewalling about the scope of the violation induced an exasperated Foreign Intelligence Surveillance Court to accuse the NSA of “an institutional lack of candor” in connection with what the court described as “a very serious Fourth Amendment issue.” (The court is the federal tribunal created in 1978 by FISA; it is often referred to as a “secret court” because proceedings before it are classified and ex parte — meaning only the Justice Department appears before the court.)

Declassified memos: FBI illegally shared spy data on Americans with private parties
"The FBI has illegally shared raw intelligence about Americans with unauthorized third parties and violated other constitutional privacy protections, according to newly declassified government documents that undercut the bureau’s public assurances about how carefully it handles warrantless spy data to avoid abuses or leaks.
In his final congressional testimony before he was fired by President Trump this month, then-FBI Director James Comey unequivocally told lawmakers his agency used sensitive espionage data gathered about Americans without a warrant only when it was “lawfully collected, carefully overseen and checked.”
Once-top secret U.S. intelligence community memos reviewed by Circa tell a different story, citing instances of “disregard” for rules, inadequate training and “deficient” oversight and even one case of deliberately sharing spy data with a forbidden party."
The behavior the FBI admitted to a FISA judge just last month ranged from illegally sharing raw intelligence with unauthorized third parties to accessing intercepted attorney-client privileged communications without proper oversight the bureau promised was in place years ago.
The most serious involved the NSA searching for American data it was forbidden to search. But the FBI also was forced to admit its agents and analysts shared espionage data with prohibited third parties, ranging from a federal contractor to a private entity that did not have the legal right to see the intelligence.

There have been a lot of concerns about alleged surveillance on the Trump team as well as reports of surveillance on others as well, including presidential candidates.
There has been what appears to be improper use of ‘incidentally collected’ information with people like Susan Rice stonewalling about the unmasking of the collected information.
There have been all kinds of leaks as a result of this surveillance and unmasking, most with the seeming purpose to undermine President Donald Trump.
Just yesterday in testimony before Congress, former CIA Director talked about how dangerous leaks were to our national security.
Now, it seems that Rep. Trey Gowdy is finally going to do something to try to put a stop it.
Rep. Trey Gowdy (R., S.C.) on Wednesday said government surveillance programs would not receive the necessary congressional reauthorization for them to continue at the end of the year unless officials answer questions on who in the intelligence community unmasked certain individuals.
Susan Rice refused to testify about the unmasking and others have stonewalled in getting to the question about the unmasking and the leaks.
Gowdy is tired of it and he wants the answers.
“We’re not going to reauthorize these surveillance programs if the American people are not satisfied that their security is going to be safeguarded,” Gowdy told Hemmer.
“The unmasking within the intelligence community, that is a privilege to be able to request that a U.S. person’s name be unmasked and I want to know who’s making the request, what is the evidentiary basis of that request,” Gowdy continued.
He said people should also be concerned about the late in the term unmasking that went on at the end of the Obama administration.
If they don’t get the authorization, then they wouldn’t get the information and can’t leak on people.
And then that will stop a lot of the undermining from these leakers.
