In February 2003, a Florida Court of Appeals unanimously agreed with an assertion by FOX News that there is no rule against distorting or falsifying the news in the United States.
Lawyers paid by Bill O'Reilly's bosses argued in court that Fox can lie with impunity.
It's their right under the 1st Ammendment
FOX asserted that there are no written rules against distorting news in the media. They argued that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on public airwaves.
December 1996, Jane Akre and her husband, Steve Wilson, were hired by FOX as a part of the Fox “Investigators” team at WTVT in Tampa Bay, Florida.to investigat bovine growth hormone (BGH), a controversial substance manufactured by Monsanto Corporation.
Fox executives and their attorneys wanted the reporters to use statements from Monsanto representatives that the reporters knew were false and to make other revisions to the story that were in direct conflict with the facts. Fox editors then tried to force Akre and Wilson to continue to produce the distorted story.
Akre and Wilson refused and threatened to report Fox's actions to the FCC, they were both fired.
August 18, 2000, a unanimous Florida jury found that Akre was wrongfully fired by Fox Television when she refused to broadcast (in the jury's words) “a false, distorted or slanted story” The jury awarded her $425,000 in damages.
FOX appealed the case, and on February 14, 2003 the Florida Second District Court of Appeals overturned the settlement awarded to Akre.
In a stunningly narrow interpretation of FCC rules, the Florida Appeals court claimed that the FCC policy against falsification of the news does not rise to the level of a "law, rule, or regulation," it was simply a "policy." Therefore, it is up to the station whether or not it wants to report honestly.
During their appeal, FOX asserted that there are no written rules against distorting news in the media. They argued that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on public airwaves. Fox attorneys did not dispute Akre’s claim that they pressured her to broadcast a false story, they simply maintained that it was their right to do so.
Fox then filed a series of motions seeking more than $1.7 million in trial fees and costs from both Akre and Wilson.

DD, yesterday the gasman fixed 2 of the 3 gas leaks.
He couldn't fix the third one which was next to the furnace, so he had to turn the furnace off.
I called some plumbers, one called me back, it would cost $200 to put in a 1/2 inch union.
Called my handy man, but couldn't get a hold of him.
Thank god I have friends who have sons that can fix problems like this.
The part was $8.50, took 25 minutes to fix. He didn't charge me for anything.
Today I bought him a box of 72 k-cups.

Dear Diary,
It is amazing how much they charge for labor. I don't like messing with large things like a furnace but household items, I am okay with.
When it comes to appliances, sometimes it is better to go to the store, buy the part, watch a youtube video on repairs and do it yourself. Then there are times when it's just not worth it and it is recycled. I repaired my washing machine but at this point if it breaks again, I will get a new one.

Our friends over at Mother Jones have delivered the goods once again.
It seems like, wait no, never mind. Scratch that. It’s now abundantly clear that Bill O’Reilly lied about his reporting in places like the Falklands, Argentina, and El Salvador. Yep, he lied.
All of the details can be found in David Corn and Daniel Schulman’s fabulous reporting (in the hat tip below) but let’s be very clear here: O’Reilly lit up my NBC colleague Brian Williams saying:
“…We take great pains to present you with information that can be verified…Reporting comes with a big responsibility, the Founding Fathers made that point very clearly. They said to us, ‘We’ll give you freedom. We’ll protect you from government intrusion. But, in return, you, the press, must be honest.'”

So here’s how this works folks: whether you agree or not with Brian Williams’ suspension, shouldn’t Fox’s Roger Ailes hold Bill O’Reilly to the same level of punishment and scrutiny? Shouldn’t Fox News be “fair and balanced” on this issue?
I really hate hypocrites and I really really hate GOP hypocrites. And it seems like Bill O’Reilly now leads the pack. Mr. Ailes, suspend O’Reilly immediately and save your network from itself…if you can.

Amid the controversy regarding whether or not Bill O’Reilly’s claims to have spent time in a combat zone during the Falklands War in 1982, CBS News released four archived stories from its coverage of the conflict yesterday.
O’Reilly’s involvement in CBS’s coverage came into focus last week after Mother Jones published an article questioning his statements claiming he reported from a “war zone” or “combat zone.”
MJ talked to several other CBS reporters who also covered the Falklands conflict and the protests in Buenos Aires, Argentina. They said that no member of the network’s news team actually made it to the Falklands, so any claim that O’Reilly made about being there were false. They also said the same of his claims that the protest he covered involved Argentine troops gunning down civilians.
“Here in the United States we would use tear gas and rubber bullets,” MJ reported O’Reilly said in a 2009 interview. “They were doing real bullets. They were just gunning these people down, shooting them in the street.”
And while the protest did turn violent and people were injured, no reports of the firing of real bullets were filed by media organizations at the time. In fact, they used exactly what O’Reilly said they hadn’t: rubber bullets and tear gas.
Argentine historian Federico G. Lorenz also told the Washington Post that he did not recall any fatalities from the protest.
“As far as I know, there were no people killed at the protests after the news of the Argentine surrendering arrived to [Buenos Aires]. There were incidents at May Square … and people slightly injured due to gasses and anti-riot munition, but not dead people. Press from June 15, 1982, reports about five busses burnt, ‘many detainees and injured people.’ One of the photographs shows precisely a wounded [person] lying surrounded by people.”
Had O’Reilly simply said that he had covered a protest that turned violent and people were injured, no one would be questioning his claims. Instead, he chose to embellish and outright lie about his experiences and, after nearly 33 years, those lies are finally catching up to him.

n the first vote, the Senate voted to kill language from Sen. Ed Markey (D-Mass.) that would require any oil that moves through the pipeline to be refined and consumed in the United States, to help reduce U.S. dependence on foreign oil. That proposal was “tabled,” or killed, in a 57-42 vote.
Markey has said for several months that the Keystone project should only be approved with his language to stop the export of oil that moves from Canada to the Gulf Coast. He tweeted that the Senate vote means the U.S. would continue to rely on foreign oil.
The Senate also voted 53-46 to kill a proposal from Sen. Al Franken (D-Minn.) that would have required only U.S. iron, steel and other goods to be used in the production of the pipeline.

O'Reilly's Claim To Have Seen Nuns "Shot In The Back Of The Head" Contradicted By His Own Timeline
Bill O'Reilly has claimed repeatedly that he witnessed the execution of nuns while reporting in 1981 on the civil war in El Salvador, an apparent fabrication that is at odds with both history and what O'Reilly himself has said about arriving in the country after the event took place, according to new information unearthed by Media Matters.
The Fox host has faced withering scrutiny from historians, former colleagues, and others for having exaggerated his claims of being in a "combat situation" during the Falklands War.
O'Reilly's El Salvador Fabrication Revealed
Between 1980 and 1992, a civil war raged in El Salvador between the Farabundo Martí National Liberation Front (FMLN) and the government of El Salvador. On December 2, 1980, four members of the Salvadoran national guard raped and shot "three American nuns and a layworker." The tragedy ''did more to inflame the debate over El Salvador in the United States than any other single incident,'' according to a 1993 State Department report. After the death of Silvia Arriola, a member of a religious order killed six weeks after those four churchwomen, "no priests or nuns were killed in El Salvador for more than eight years," according to Dr. Anna Lisa Peterson, a professor of religion at the University of Florida.
O'Reilly has spoken on several occasions about his time covering the Salvadoran civil war as a CBS correspondent in 1981, suggesting at least twice that he witnessed the murder of the churchwomen. On the September 27, 2005, edition of his talk-radio program The Radio Factor, O'Reilly said, "I've seen guys gun down nuns in El Salvador." And on the December 14, 2012, edition of his Fox News show, O'Reilly spoke of telling his mother that "I was in El Salvador and I saw nuns get shot in the back of the head."
However, O'Reilly could not possibly have witnessed the murder of the churchwomen if his own timeline is to be believed. The former CBS correspondent only arrived in El Salvador in 1981, as he mentioned on the February 22, 2002, edition of The O'Reilly Factor, saying (according to Nexis transcript), "Before I went to El Salvador in 1981, I talked with some experienced Latin American experts, people who had seen the brutal wars down there for themselves. I had never been in a war zone before, so I wanted some prep."
In his book The No Spin Zone, O'Reilly devotes several pages to his tenure covering the conflict in El Salvador, which he says began "a few weeks" after he was promoted to CBS News correspondent in 1981. O'Reilly details a reporting assignment in which he arrived at the village of Meanguera shortly after it had been "wiped out" by the rebels and witnessed "carnage" that was "obviously recent." But he makes no mention of seeing nuns, or anyone else, being killed while he reported from El Salvador. Nor does O'Reilly mention the killings in his discussions of his reporting from that country in his memoir, A Bold, Fresh Piece of Humanity.
O'Reilly even admitted he had arrived in El Salvador "right after" the killings during an interview on WVVH-TV's American Dreams Show on September 26, 2009, apparently contradicting his other assertions that he'd witnessed them (emphasis added):
O'REILLY: Now, a Jesuit priest told me about that in El Salvador. It was interesting, I was talking to the guy because these nuns had been slaughtered in El Salvador, and I was down there right after that -- they shot like a dozen, killed a dozen nuns.

Yes, one of the most vocal opponents of Obamacare is signing up for it, but why? You see, Senator Cruz currently gets his health insurance through Goldman Sachs and his wife is taking unpaid leave (must be nice, huh?) to work on his presidential campaign, as Bloomberg reported yesterday: Heidi Cruz, a managing director at Goldman Sachs Group Inc. in Houston, has taken an unpaid leave from her private wealth-management job to help with her husband’s campaign for the U.S. presidency, a person familiar with the matter said. Ted Cruz, 44, a Republican senator from Texas, said on Twitter early Monday morning that he plans to run for president in the 2016 election. Heidi Cruz’s leave will last the duration of the campaign, said the person, who asked not to be identified speaking about Cruz’s employment. (Source) This is certain to upset the millions of people who have been told over and over again since the Affordable Care Act was passed that it was the worst thing to happen to America since slavery. Yes, Dr. Ben Carson, a potential challenger to Ted Cruz in 2016 for the GOP presidential nomination actually said that back in 2013 at a Value Voters Summit – and you know that this will be brought up repeatedly during Republican primary debates by anyone wanting to take a rhetorical shot at the senator from Texas. Ted Cruz hasn’t made much mention of his wife’s job, probably in part because it’s at Goldman Sachs, but that’s where his insurance coverage comes from and he is losing it now that Heidi will be taking this unpaid leave to work on his campaign. Back in 2013, it was revealed that Ted Cruz, who had chastised other members of Congress for receiving federally-subsidized healthcare, was getting his own coverage through Goldman Sachs, his wife’s employer: Texas GOP Sen. Ted Cruz, who has repeatedly blasted fellow members of Congress and legislative staffers for accepting federal health insurance support, has revealed that his coverage is provided through his wife, a Goldman Sachs executive. Cruz’s office told CNN Thursday that Cruz is covered by his wife’s policy. Duck Dynasty Star Fantasizes About Rape And Murder Of Atheist Family At Prayer Breakfast

At a Friday prayer breakfast in Vero Beach, Florida, Duck Dynasty star, Phil Robertson gave a truly bizarre speech where he fantasized aloud about an atheist family being raped, tortured, and murdered. Robertson, the reality TV star turned right-wing folk hero, was trying to expound upon the dangers of atheism at the prayer breakfast. Robertson’s tirade against atheism took a bizarre turn, however, as his speech turned into a gruesome, macabre tale. Robertson told the audience a graphic morality play, as follows:
I’ll make a bet with you. Two guys break into an atheist’s home. He has a little atheist wife and two little atheist daughters. Two guys break into his home and tie him up in a chair and gag him. And then they take his two daughters in front of him and rape both of them and then shoot them and they take his wife and then decapitate her head off in front of him. And then they can look at him and say, ‘Isn’t it great that I don’t have to worry about being judged? Isn’t it great that there’s nothing wrong with this? There’s no right or wrong, now is it dude?’
Then you take a sharp knife and take his manhood and hold it in front of him and say, ‘Wouldn’t it be something if this [sic] was something wrong with this? But you’re the one who says there is no God, there’s no right, there’s no wrong, so we’re just having fun. We’re sick in the head, have a nice day.
Robertson was attempting to point out the dangers of atheism, but instead he revealed his own depravity. For a religious fundamentalist like Phil Robertson, God is needed to prevent men from raping, torturing and killing their fellow human beings.
Perhaps that is the only thing stopping Robertson from committing rape and murder, as evidenced by his barely concealed glee in describing the fate of the atheist family. However, what Robertson fails to grasp is that for many atheists, secular humanists, mainstream Christians, and sensible people of all faiths, the threat of burning in hell is not necessary to deter us from raping and killing our fellow human beings. He may need the threat of eternal damnation from a cosmic being, to prevent him from acting on his most base impulses, but most people in the world don’t.
