My husband walked out in 2010, we are not divorced or legally separated. But in my heart I am divorced and its over. So I do what I want, just like he is doing with his new gf of 2 yrs.

The answer is NO...This is fact. When one spouse is served with divorce papers, the parties are free to do what they please including relations with other people.

It's all situational. There are only a few states with laws Against sleeping with people Other than your spouse While married For example North Carolina requires you to be separated for one whole year before filing for divorce And if it any time you sleep with someone that is not your spouse Not only can the other spouse Sue The cheating spouse But it is also a punishable offense With a $750 fine and up to one year in jail It really all comes down to Morals If you're separated but only one person wants the separation Then sleeping with someone that is not your spouse is morally incorrect and could be easily considered cheating Even if you File for divorce And your spouse doesn't want a divorce It is still morally incorrect to sleep with someone other than your spouse Anyone who seeps with someone other than their spouse while still legally married Does not take marriage seriously and should never have been married in the first place. The only time that sleeping with someone other than your spouse while still married is acceptable By moral or social standards Is when both parties agree that divorce is going to happen Or During a separation Where both parties agree it's okay to see other people. In all it comes down to your morals. And the best way to decide if something is morally correct or incorrect Just to try to place yourself in the other person's shoe's. If you're the one doing the cheating You should First Ask yourself If I wanted to stay in the marriage But my spouse didn't How would I feel if my spouse slept with someone else. If you're the one that wants to stay in the marriage It's understandable to want to cheat When you find out your partner is cheating as well But again that comes down to morals and Whether or not a final decision of divorce Has been agreed upon.

Yes, you can be fined and incarcerated if cheating BEFORE served divorce papers in New York but the other party needs collaborating witnesses in order for such to happen. In October of 2010 New York State passed the the no fault law which everyone uses as their grounds. I can only tell you the New York State law as I am unfamiliar with other state laws.

It depends on your situation. If you know papers have been filed and you are just waiting for the official papers then the answer is no.
If you aren't sure you really want a divorce and are just "testing the waters" then yes.
I personally didn't start dating until I got final papers from the court stating my divorce was final.

Me and my wife seperated.. The day after I left she slept with another man.. And 4 days after that with a different man.. And 2 weeks after that with another man.. And is now dating that last one.. I find her a slut and a b*tch.. If you want her to hate you.. Go for it.. If not then don't do it.. I think it's committing adultery if done before the the divorce is final.  this is a topic that makes me angry as you can see

Why even bring this up..if you were playing a game of horseshoes, you get points for being close...why get anywhere close to cheating and next get caught...why would she expect it unless you cheated before and can prove in from of a judge you may become glue from a dead horse shoe...being funny what you do is only important to you imo...not public news...

Sorry to say you know that but chances she was cheating during your marriage too...take. thief at work that finally gets caught. Chances are how many times in past employment did he steal and not get caught until he had..same thing

If one is married to the other, sex during divorce is not cheating -- unless you are cheating yourself out of your divorce since the court does look at having sex between the married when they rule on the divorce action.

In Idaho and Utah its a felony only 33 states have adultery laws. You are not divorced until a judge says you are legally separated. Not only is the married person guilty but the non married person is also guilty of adultery. No matter what anyone says here to say you or the other is not guilty tthey're wrong. Google it.
