Recently, the county wanted to come in and appropriate some additional right-of-way to lay new waterlines (in excess of their already existing 12' allotment).
They even had the audacity to send their backhoes onto the property and get ready to trench my field line. All with no landowner agreement or acknowledgement.
When it comes time for the first cutting is it going to be a violation of the right-of-way if the rakes and balers extend, or lay cuttings, across the newly proposed right-of-way?
Note: county laws have not been modified, or changed, in lieu of this new upgrade.

Around here they only have an easment/right of way, they do not own any of the land and we still farm, raise cattle on, bail hay, infact they have to bury the line below plow depth so we can plow right on top of it. There are some building restrictions though we can't build any structures on it and they must always have access to it, but if they make ruts or damage our crop, they have to pay damages.

Thanks, sureshot ... When 'they' encroach and take footage from my acreage that reduces my land size it miffs me -- they should have to pay me for 'land use' in addition to damages, shouldn't they?

its still ur land u can plant it as far as damages it will vary from state\county but mostly as long as they stay on rite away not much u can do any damage beyond rw they have to pay

That's sucks... If they ever widen the roads here, they will have to use some of my land.

The County has 30 feet from the middle
of road either way.If they go over that
they have to pay you for the land they
need to use.They have set prices for that
so don't look to make a killing.

If they are taking land they aren't allowed to call the sheriff just for political right first moves and then call the nearest newspaper or radio talk show like rush.shaun hanady etc they'll love to get in on the topic....i just bought a small 21 acre parcel in lassen county ca I'm looking for people close and far that want to help me build a earthship style house..youtube can show u the design of what I'm looking for...i need help though I'm trying to find people with machinery that can loan it to me or that they'll operate to help ...click on my profile and msg me if ur interested its near termo and ravendale ca....

10 years ago the county ran a water line across the east side of my property and paid me 300 bucks. Last year they ran another water line across the west side of my property and paid 500 bucks. Here in Oklahoma they don't own the land. But they do have an easement on both sides of the road from the center of the road and 50 feet to either side. They can't take your land without paying you the appraised market value of it.
