In Wednesday s Farminton Daily Times newspaper, there is a story about a kitchen worker at our detention center that had sex with a inmate. I worked there for ten years as a officer, i saw this behavor before.( Suprisingly enough, it was more often the females that got involved with the inmates.) they were always fired and escorted off the property when it could be proven. I never knew of any of those females being charged with rape. By defintion it is because a inmate cannot legally consent to sex. The kitchen is run by a seperate company so they have different rules. I found the whole thing very interesting....
What do you think? Should this be charged as rape?

This sounds like A Legal No mans land of unexplored Territory there. Here it doesn't matter who makes contact first; both parties are subject to major punishment. The Prisoner gets more time added and Privileges taken away and the employee gets Canned along with being charged with a felony and Jail Time as well, hefty fine, probation, counseling and loss of benefits built up. Both parties consented unless caught on Camera for the Act!

Most of the time, the inmate can pick out who is vulnerable or has low self esteem and will fall for what they say. Then when the officer or whoever get fired, the inmate moves on to the next one. I only know of one that the inmate got out and they r still together. I just think the definition of rape is a little blurred here...
