In a story (link below) Mr. Lawrence Sellin, Ph.D. a retired colonel with 29 years of experience in the US Army Reserve, argues that Senator Ted Cruz entered the United States illegally as a child in 1974. His parents failed to file a CRBA form which is required by US law. Ted’s parents did not fill out the required form until 1986. According to the Gateway Pundit article, regarding Ted Cruz citizenship and eligibility to run for office: “Exactly how and when did Ted Cruz obtain U.S. citizenship? The fact that it is still an open question at this stage of the Presidential campaign is a testament either to the galactic ignorance of our political-media elite or their willingness to place political expediency ahead of the Constitution and the law. Legally, Cruz could have obtained US citizenship through his mother consistent with Public Law 414, June 27, 1952, An Act: To revise the laws relating to immigration, naturalization, and nationality and for other purposes [H.R. 5678], Title III Nationality and Naturalization, Chapter 1 – Nationality at Birth and by Collective naturalization; Nationals and citizens of the United States at birth; the relevant section being 301 (a) (7): “a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than ten years, at least five of which were after attaining the age of fourteen years: Provided That any periods of honorable service in the Armed Forces of the United States by such citizen parent may be included in computing the physical presence requirements of this paragraph.” In that case, Cruz’s mother should have filed a Consular Report of Birth Abroad of a Citizen of the United States of America (CRBA) with the nearest U.S. embassy or consulate after the birth to document that the child was a U.S. citizen. According to Cruz spokeswoman Catherine Frazier, Cruz’s mother did register his birth with the U.S. consulate and Cruz received a U.S. passport in 1986 ahead of a high school trip to England. There are two apparent contradictions regarding how and when Ted Cruz obtained US citizenship. First, according to the Canadian Citizenship Act of 1946, also referred to as the “Act of 1947,” Canada did not allow dual citizenship in 1970. The parents would have had to choose at that time between U.S. and Canadian citizenship. Ted Cruz did not renounce his Canadian citizenship until 2014. Was that the choice originally made? Second, no CRBA has been released that would verify that Ted Cruz was registered as a U.S. citizen at birth. Cruz’s father, Rafael Bienvenido Cruz, has affirmed that he became a Canadian citizen during that time. On August 19, 2013, The Dallas Morning News reported that Cruz was born a dual Canadian-U.S. citizen, although no documentary evidence has been presented. Cruz’s birth certificate released to the publication at the time confirms his Canadian birthplace. In response, Canadian immigration attorneys and government officials reportedly told the newspaper that anyone born in Canada, regardless of the parents’ citizenship, is automatically granted Canadian citizenship. How, they will wonder, did a man so devoid of professional accomplishment beguile so many into thinking he could manage the world’s largest economy, direct the world’s most powerful military, execute the world’s most consequential job? Imagine a future historian examining Obama’s pre-presidential life: ushered into and through the Ivy League, despite unremarkable grades and test scores along the way; a cushy non-job as a “community organizer;” a brief career as a state legislator devoid of legislative achievement (and in fact nearly devoid of his attention, less often did he vote “present”); and finally an unaccomplished single term in the United States Senate, the entirety of which was devoted to his presidential ambitions. He left no academic legacy in academia, authored no signature legislation as a legislator. And then there is the matter of his troubling associations: the white-hating, America-loathing preacher who for decades served as Obama’s “spiritual mentor;” a real-life, actual terrorist who served as Obama’s colleague and political sponsor. It is easy to imagine a future historian looking at it all and asking: how on Earth was such a man elected president? There is no evidence that he ever attended or worked for any university or that he ever sat for the Illinois bar. We have no documentation for any of his claims. He may well be the greatest hoax in history. Not content to wait for history, the incomparable Norman Podhoretz addressed the question recently in the Wall Street Journal: To be sure, no white candidate who had close associations with an outspoken hater of America like Jeremiah Wright and an unrepentant terrorist like Bill Ayers, would have lasted a single day. But because Mr. Obama was black, and therefore entitled in the eyes of liberal- dom to have hung out with protesters against various American injustices, even if they were ‘a bit’ extreme, he was given a pass. Let that Sink in: Obama was given a pass – held to a lower standard because of the color of his skin. Podhoretz continues: And in any case, what did such ancient history matter when he was also so articulate and elegant and (as he himself had said) “non-threatening,” all of which gave him a fighting chance to become the first black president and thereby to lay the curse of racism to rest? Podhoretz puts his finger, I think, on the animating pulse of the Obama phenomenon – affirmative action. Not in the legal sense, of course. But certainly in the motivating sentiment behind all affirmative action laws and regulations, which are designed primarily to make white people, and especially white liberals, feel good about themselves. Unfortunately, minorities often suffer so that whites can pat themselves on the back. Liberals routinely admit minorities to schools for which they are not qualified, yet take no responsibility for the inevitable poor performance and high drop-out rates which follow. Liberals don’t care if these minority students fail; liberals aren’t around to witness the emotional devastation and deflated self-esteem resulting from the racist policy that is affirmative action. Yes, racist. Holding someone to a separate standard merely because of the color of his skin – that’s affirmative action in a nutshell, and if that isn’t racism, then nothing is. And that is what America did to Obama. True, Obama himself was never troubled by his lack of achievements, but why would he be? As many have noted, Obama was told he was good enough for Columbia despite undistinguished grades at Occidental; he was told he was good enough for the US Senate despite a mediocre record in Illinois; he was told he was good enough to be president despite no record at all in the Senate. All his life, every step of the way, Obama was told he was good enough for the next step, in spite of ample evidence to the contrary. What could this breed if not the sort of empty narcissism on display every time Obama speaks? In 2008, many who agreed that he lacked executive qualifications nonetheless raved about Obama’s oratory skills, intellect, and cool character. Those people – conservatives included – ought now to be deeply embarrassed. The man thinks and speaks in the hoariest of cliches, and that’s when he has his Teleprompters in front of him; when the prompter is absent he can barely think or speak at all. Not one original idea has ever issued from his mouth – it’s all warmed-over Marxism of the kind that has failed over and over again for 100 years. (An example is his 2012 campaign speeches which are almost word for word his 2008 speeches) And what about his character? Obama is constantly blaming anything and everything else for his troubles. Bush did it; it was bad luck; I inherited this mess. Remember, he wanted the job, campaigned for the task. It is embarrassing to see a president so willing to advertise his own powerless-ness, so comfortable with his own incompetence. (The other day he actually came out and said no one could have done anything to get our economy and country back on track). But really, what were we to expect? The man has never been responsible for anything, so how do we expect him to act responsibly? In short: our president is a small-minded man, with neither the temperament nor the intellect to handle his job. When you understand that, and only when you understand that, will the current erosion of liberty and prosperity make sense. It could not have gone otherwise with such an impostor in the Oval Office.

The news broke late this afternoon that the 79-year-old Supreme Court Justice died in his sleep while on a hunting trip in Texas. This is a sad day for our nation as we mourn the loss of one of the country's most brilliant and ardent supporters of the Constitution. I had the honor and privilege of knowing Justice Scalia for the more than 25 years that I have practiced before the court. Justice Scalia had a keen understanding of what our Founding Fathers intended and dedicated his life to carrying out the rule of law. Justice Scalia will be deeply missed by so many who understood and respected his passion for justice and the rule of law. Justice Scalia was the longest serving of the current sitting justices, having taken his seat on the high Court in 1986. Prior to his appointment to the Supreme Court by President Reagan, Justice Scalia served as a law professor, an assistant attorney general in the Justice Department, and a judge of the United States Court of Appeals for the District of Columbia Circuit. His conservative jurisprudential legacy will be long remembered and his passion for the Constitution should not be forgotten.

No Wonder Millennials Love Him So Much. 2016: Democratic presidential hopeful Bernie Sanders said Monday his parents would never have thought their son would end up in the Senate and running for president. No kidding. He was a ne’er-do-well into his late 30s. “It’s certainly something that I don’t think they ever believed would’ve happened,” the unabashed socialist remarked during CNN’s Democratic town hall forum, as polls show him taking the lead in Iowa and New Hampshire. He explained his family couldn’t imagine his “success,” because “my brother and I and Mom and Dad grew up in a three-and-a-half-room rent-controlled apartment in Brooklyn, and we never had a whole lot of money.” It wasn’t as bad as he says. His family managed to send him to the University of Chicago. Despite a prestigious degree, however, Sanders failed to earn a living, even as an adult. It took him 40 years to collect his first steady paycheck — and it was a government check. Sanders spent most of his life as an angry radical and agitator who never accomplished much of anything. And yet now he thinks he deserves the power to run your life and your finances — “We will raise taxes;” he confirmed Monday, “yes, we will.” One of his first jobs was registering people for food stamps, and it was all downhill from there. The article goes on to explain that Bernie tried a few different career paths and basically sucked at all of them. Friends described him as a “slob” and said his electricity was always turned off and he could rarely make rent. The only thing he was good at was expounding the virtues of socialism and complaining about how American capitalistic greed was to blame for all poverty, everywhere. Which I guess was enough to become elected mayor of Burlington, Vermont at age 40, which is when he started earning a steady paycheck – the first in his life. There you go. Thousands of college kids getting pointless degrees in gender studies and crying about trigger warnings and are unable to get an Actual Job to pay back the hundreds of thousands of dollars in student loan debt are flocking to a deranged old man who only got a steady paycheck because he convinced people to elect him mayor (which makes me wonder – what were the citizens of Burlington smoking that election year?) Basically, if Bernie Sanders can get by in life without a job or responsibilities and let taxpayers pay his own way, and then run for president, there is hope for the hipster generation crying out for “free” college and “free” healthcare and higher taxes to pay for all this free crap. They should start a club: Bums and Freeloaders for Socialism! Losers Electing Losers! Yay! The IBD article summarizes the 2016 election thusly and I think they hit the nail on the head – Sure, Sanders may not be a hypocrite, but this is nothing to brag about. His worthless background contrasts sharply with the successful careers of other “outsiders” in the race for the White House, including a billionaire developer, a world-renowned neurosurgeon and a Fortune 500 CEO. The choice in this election is shaping up to be a very clear one. It will likely boil down to a battle between those who create and produce wealth, and those who take it and redistribute it. It’s Makers vs. Takers this year. And considering how easy it is to take rather than make… We are so doomed.
