Common sense would prevail here: If you force yourself on your spouse it is rape. They do have a choice to say no.

What should be highly illegal is the asking of stupid questions.

While I don't believe it should be illegal, if you continually refuse to have any affection or intimacy with your spouse, I consider it cheating on your marital vow to love, honor, and cherish that person, in sickness and in health, till death do you part.

While I would have common sense compassion in a marriage if the wife truly had a headache or something, it is technically cheating the vows if she doesn't put out while she's sick.

I could care less as far as I am personally concerned. I'm a huge pervert that enjoys sex when I'm with a trusted significant other so there would be no change to me. o.o For the sake of others that do not enjoy it as much, there should never be a law that treats anyone as if they were a slave or beneath whom they've married.
