Some talking heads contend that if Obama wants to sit a new Supreme Court Justice all he has to do is nominate someone that the Senate already confirmed for a lower court. It has been suggested he could nominate someone like a particular DC Circuit Judge of Indian/Asian descent that the Senate confirmed earlier for the DC Circuit. I apologize that I can't pronounce or spell the fellas name.
The logic is that they would be obligated to confirm someone they already confirmed for another court. That is an empty and completely silly argument. For example, if you "hire" someone as an Executive Vice President that doesn't mean you are obligated to accept or select them for the role of CEO. While a Judge might be well qualified for a lower level job; that doesn't mean he is qualified for the top one.

It's a Sri (like Sri Lanka) something name.....but I don't think that will be the one he nominates.

I don't think it matters much who he nominates. They'll go through the process and because conservatives control the Senate he'll not get a confirmation. Besides, we don't need any more legislators on the court and that is the only kind of lawyer Obama would propose.

That isn't necessarily correct about the Senate.
Some of those Senators already know mist of the potential nominees and are friendly toward them. In those cases it is not a party-line preference but a personal preference. And, yes, the Republicans have control but the Conservative Republicans do not.

ha, every federal judge that has taken the bench since obama was elected was confirmed by the senate.
