SAN FRANCISCO -- Dealing a blow to gun supporters, a federal appeals court ruled Thursday that Americans do not have a constitutional right to carry concealed weapons in public.
In a dispute that could ultimately wind up before the Supreme Court, a divided 9th U.S. Circuit Court of Appeals said local law enforcement officials can place significant restrictions on who is allowed to carry concealed guns.
By a vote of 7-4, the court upheld a California law that says applicants must cite a "good cause" to obtain a concealed-carry permit. Typically, people who are being stalked or threatened, celebrities who fear for their safety, and those who routinely carry large amounts of cash or other valuables are granted permits.
"We hold that the Second Amendment does not preserve or protect a right of a member of the general public to carry concealed firearms in public," Circuit Judge William A. Fletcher wrote for the majority.
The ruling overturned a 2014 decision by a three-judge panel of the same court that said applicants need only express a desire for personal safety.
In a dissent, Circuit Judge Consuelo M. Callahan said the ruling "obliterates the Second Amendment's right to bear a firearm in some manner in public for self-defense."
Three other federal appeals courts have ruled similarly in the past, upholding California-like restrictions in New York, Maryland and New Jersey. In addition, another federal appeals court struck down Illinois' complete ban on carrying concealed weapons.
The 9th Circuit covers nine Western states, but California and Hawaii are the only ones in which the ruling will have any practical effect. The others do not require permit applicants to cite a "good cause." Anyone in those states with a clean record and no history of mental illness can get a permit.
The National Rifle Association called the ruling "out of touch."
"This decision will leave good people defenseless, as it completely ignores the fact that law-abiding Californians who reside in counties with hostile sheriffs will now have no means to carry a firearm outside the home for personal protection," said NRA legislative chief Chris W. Cox.
The New York-based gun control organization Everytown hailed the decision as "a major victory for public safety."
The California case began in 2009, when Edward Peruta filed a legal challenge over the San Diego County sheriff's refusal to issue him a permit. Peruta said he wanted a weapon to protect himself, but the sheriff said he needed a better reason, such as that his occupation exposes him to robbery.
Peruta, who is known as something of a legal gadfly, said he is neither a hunter, collector or target shooter but challenged the law because he believed it violated the Constitution. The NRA joined him in fighting the law.
The San Diego Sheriff's Department said Thursday that since the 9th Circuit tossed out the law two years ago, it has received 2,463 applications from people seeking a concealed-weapon permit without having to show good cause.
Sheriff's lawyer Robert Faigan said the department hasn't processed those applications and will continue to hold on to them while it waits to see what the Supreme Court does.

This is something I've been thinking about for a while and I think it's time to set a few things straight about the Constitution and the Bill of Rights.
The term "constitutional right" is antithetical to the founding principles of America. "Constitutional right" insinuates that a right is a dispensation from the government. We often hear people say, "The First Amendment gives me the right to say bla,bla,bla", or, "The Second Amendment gives me the right to have to own a gun". Really that's an ass-backwards way of looking at the Constitution.
Imagine if there were no Constitution or Bill of Rights.
Would you then be unable to speak? Of course not.
What the Constitution does is prohibit the "government", specifically the "federal government", from infringing on your right to speak freely.

drive by media, does not want you to look at it in that perspective. The left wants the populace to believe that rights are dispensations from the government. A WELL REGULATED (law abiding-self disciplined) MILITIA (The citizens, who are willing and able to stand and fight) BEING NECESSARY TO THE SECURITY OF A FREE STATE, ( Without the just mentioned law abiding citizens, freedom will not be secured. Freedom will cease to exist.) THE RIGHT OF THE PEOPLE ( signifying a pre-existing right, not granting a right.) TO KEEP (own) AND BEAR (Carry, on their person) ARMS (weapons) SHALL NOT BE INFRINGED. (May not be taken, altered or diminished by the government.)

Milo Yiannopoulos has hit out at Twitter after they suspended his account earlier today, accusing the social networking service of being “Sharia-compliant” and in financial freefall.
In a press conference at Ground Zero Orlando, delivering a truncated speech following Sunday’s mass shooting — one he was supposed to give on Muslims and gays at the University of Central Florida (UCF), which was canceled by campus police — Yiannopoulos said Muslim campaigners were responsible for him briefly thrown off Twitter this morning.
Milo told a lively crowd that influential news aggregation site The Drudge Report linking to Heat Street’s article on him directly resulted in him being re-instated on Twitter. He said: “My Twitter account was suspended as a result of a campaign by Muslim tweeters. It has been re-instated because the Drudge Report put my picture on the front page with a gigantic headline- thank you Matt Drudge- saying ‘Twitter tells Milo to go to hell!’
“It was Muslims who told me to go to hell and I’m glad to see that Twitter very quickly panicked and backtracked and reinstated my Twitter account today. If it goes down again, who knows?,” he said.
Referencing Prince Alwaleed Bin Talal, Milo said: “Twitter, whose largest investor is a Saudi, has become, to some degree, Sharia compliant in the last six-months. I think American universities are becoming Sharia-compliant too.”
Milo added: “Conservatives haven’t demonstrated a particular aptitude for social networks. There are conservatives who run tech companies but they tend to come in later when the company really needs someone who understands numbers. You’re not going to change the politics of Silicon Valley.
“I don’t have any realistic expectation that any social networking company or silicon valley start-up is going to discover a commitment to free speech or discover a commitment to fairness to conservative points of view. The best you can do is hold their feet to the fire when they f**k up and when they f**k up too much the stock price plummets and the company collapses which is what’s happening with Twitter right now.”
Milo also slammed the decision of campus police to postpone his talk at UCF which was scheduled for Tuesday. He said: “What they couldn’t do is spare 6 or 8 officers to let a gay man say what the media won’t tell you, say what politicians won’t say, say what your celebrities are too f**king dumb to realize which is that this is not radical Islam, it is not terrorists forcing Obama to say radical Islam is only 25% of the war…the rest of the battle is being honest about about the challenges you face in this country.”
Milo is having a press event in Orlando outside a church that’s collecting donations for victims. Shameful fame-wh*re. Completely unhelpful.
Milo said the shooting in Orlando nightclub had made him support Donald Trump’s proposed ban on Muslim immigration: “After Orlando I’m all in favor.”
Talking about safe spaces, he said: “Gun-free zones provide safe spaces for killers. The left likes to talk about safe spaces- well safe spaces for murderers are gun-free zones.”
Milo contrasted the left’s attitude to Muslims versus socially conservative Christians: “Stop listening to the left. Stop listening to people who say peace, love and understanding and pacifism is going to save you. It didn’t save those people in the nightclub…there is no competition between declining to bake a cake and taking to a nightclub and killing or hurting 100 people. It is offensive and ridiculous and I don’t use the word ‘offensive’ very much but that is.”
Milo added: “I’m here to give you a warning from Europe. I know what happens when governments and the media to pander to and to mollycoddle Islam. I know what happens to gay people, to trans people, to women and all the minorities the left claims that it is here to defend.
“The politicians do not have your back, the media do not have your back, people are not going to protect gays or women or blacks or Latinos or any other minority. You’ve got to do it for yourself.”

Attorney General Maura Healey has launched a sweeping investigation into possible safety problems involving guns manufactured by at least two major companies, Remington and Glock, according to lawsuits filed by both firms, which are fighting Healey’s efforts.
The lawsuits reveal that this year, Healey invoked her powers under the state’s consumer protection law to demand that both companies turn over a wide range of documents, including safety-related complaints from customers and the companies’ responses.
The investigation is the second prominent battle Healey is waging against the gun industry. In July, she angered gun owners and manufacturers when she moved to bar the sale of military-style rifles that have been altered slightly to evade the state’s ban on assault weapons.
In her newly disclosed legal action, Healey argues Glock firearms are “prone to accidental discharge” and makes clear in court papers that she is concerned the company may have been warned about the problem and failed to act.
Responding to Glock’s lawsuit, she referenced news stories about a sheriff's deputy accidentally firing a Glock pistol in San Francisco’s Hall of Justice, a Los Angeles police officer who was paralyzed from the waist down after his 3-year-old son accidentally fired his Glock pistol, and a Massachusetts man who was dancing at a July 4th party when his Glock handgun fired while it was in his pocket.
A Healey spokeswoman said the attorney general is asking gun manufacturers to turn over customer safety complaints because firearms are one of the only products not regulated by the federal Consumer Product Safety Commission.
“As the chief law enforcement office in Massachusetts, we are seeking that information to better inform our residents and to protect them from any safety or manufacturing issues with guns sold here,” Cyndi Roy Gonzalez said. “It’s unfortunate that these gun manufacturers have taken our office to court rather than comply with a simple request for consumer complaints and related information.”
Both Remington and Glock have sued Healey in Suffolk Superior Court, arguing that she is abusing her authority by casting a broad net for documents, including those related to accidental discharges, past lawsuits, legal settlements, and product recalls.
Glock Inc.’s lawsuit asks the court to quash Healey’s inquiry.
The company, based in Smyrna, Ga., points to statements Healey has made calling gun violence a “public health crisis” and an “epidemic” to argue the “true purpose” of her investigation is “to harass an industry that the attorney general finds distasteful and to make political headlines by pursuing members of the firearm industry.”
Healey responds in court papers that Glock’s contention that she is politically motivated is “both incorrect and irrelevant,” given the concerns she has about the company’s handguns firing accidentally. She also says the state’s consumer protection law clearly gives her the authority to investigate safety concerns about products, including guns, that are available in Massachusetts.
Glocks can be sold only to law enforcement officers in Massachusetts, because consumer sales are banned under state law. As such, Glock argues, Healey is misusing her investigative powers “for the ulterior purpose of harassing an out-of-state company that does not engage in in-state consumer sales.”
But Healey says that, despite the state’s ban, 10,000 Glocks were sold in Massachusetts between January 2014 and August 2015, including 8,000 to buyers who do not appear to be law-enforcement officers. She said the handguns ended up in the hands of Massachusetts consumers “irrespective of whether the sales were made legally or not.”
“The investigation is appropriate,” Healey’s office writes in its rebuttal to Glock, because Glock may have liability under the state’s consumer protection law for “product defects, misleading marketing, and for failure to honor warranties.”
Remington Arms Co., based in Madison, N.C., contends Healey’s investigation is “unreasonable and excessively burdensome” because she is seeking product files from every state and country, even though fewer than 1 percent of the files relate to Massachusetts customers.
Because Healey’s office “has provided virtually no information concerning the subject or object of its investigation, one cannot imagine what possible relevance product service files from Hawaii or Manitoba, Canada, could have on the AG’s investigation in Massachusetts,” Remington states in its lawsuit, filed Monday.
Remington is asking the court to limit the scope of Healey’s investigation and allow it to remove customer information from the documents it turns over.
If customer information is not removed, the company argues, its customers’ privacy rights would be violated, conduct protected by the Second Amendment would be chilled, and Remington’s business would be harmed.
Healey has not yet responded in court to Remington’s accusations.
Healey’s court papers, however, indicate that Remington and Glock are not the only gun makers she is targeting. Both are “part of a larger series of similar gun safety investigations,” Healey’s office wrote.
Healey, a Democrat who took office last year, has made reducing gun violence a top issue — a crusade that has won her support from national gun-control advocates and the ire of gun owners and gun rights groups.
In December, she warned the state’s 350 licensed gun dealers that they must obey the state’s strict gun laws and began investigating several dealers suspected of selling illegal firearms.
In May, she led a dozen attorneys general in calling on Congress to allow the Centers for Disease Control and Prevention to study gun deaths as a public health issue.
A day later, she spoke at a White House gun violence summit, where she decried the legal immunity Congress has granted to gun makers.
“This is the only product of its kind for which Congress has given the industry extensive freedom from liability,” she said at the White House. “That’s not right. The gun industry should be held to the same liability standards as the manufacturers and sellers of other consumer products.”
In July, she drew national attention when she moved to bar sales of so-called copycat assault rifles that had been modified slightly to evade the state’s 1998 assault weapons ban.
Gun enthusiasts snapped up the rifles in a buying frenzy, and then protested outside the State House.
The National Shooting Sports Foundation, meanwhile, said it would challenge Healey’s ban in court, arguing it hurt gun dealers and “made potential felons out of tens of thousands of law-abiding citizens.”

Swiss fear EU effort to tighten gun control could disarm law-abiding citizens
Swiss gun rights proponents fear a new European Union measure to tighten gun control could disarm thousands of law-abiding citizens, Reuters reports.
The proposed gun restrictions which Switzerland, a non-EU member, would be obliged to implement under cross border agreements, has raised hackles among the Swiss, who resent intervention from Brussels, the news wire reported.
It also comes at a time of increased tensions between Switzerland and the EU over Swiss efforts to curb immigration.
Christopher Blocher, a leading voice of the Swiss right, told Reuters Switzerland should end its participation in the system of passport-free travel if the tighter gun restrictions are defeated in a referendum.
The proposed measure would curb online weapons sales and impose more restrictions on assault weapons, the according to Reuters. It was drafted after the ISIS terrorist attacks in Paris last November that killed scores of people.
The initial proposal provoked an outcry in Switzerland because it meant a ban on the long Swiss tradition of ex-soldiers keeping their assault rifles, the new wire reported.
Then two months ago, Justice Minister Simonetta Sommagrua returned from meetings in Brussels saying she he successfully negotiated against such a ban, according to Reuters. But in the fine print, the EU demanded concessions including psychological tests and club membership.
Swiss gun rights proponents also fear the restrictions could encroach on the country’s proud heritage and national identity that includes a well-armed citizenry.
“When conflicts arise, Switzerland must put its sovereignty first,” said Blocher, a businessman and vice president of the SVP, the country's biggest party, told Reuters. “In an emergency, Switzerland should be ready to exit (the cross border agreements).”
Switzerland has one of the highest rates of private gun ownership in Europe, with nearly 48 percent of households owning a gun. In France, there are about 30 weapons per 100 people, while the figure in the Great Britain is far lower, at 6.7 guns per 100 civilians, Reuters reported citing the Australian-based think tank GunPolicy.org.
However, gun-related crime in Switzerland is low and the high number of privately owned guns harks back to a long tradition of self-defense and to the Swiss policy of near-universal conscription, Reuters reported.
In 2015, 11 percent of the 20,600 soldiers who left the Swiss Army opted to keep their assault rifles which upon departure are modified to fire single shots, according to Reuters. The number of soldiers choosing to keep their weapons has been declining for several years.
Switzerland's grassroots gun lobby ProTELL, named after the 14th-century folk hero William Tell, is prepared to call for a referendum on the EU bloc’s proposal, if necessary.
“With our direct democracy, Swiss people are accustomed to having the last word,” ProTell's Dominik Riner told Reuters. “We're opposed to any and all efforts to make current weapons laws more restrictive.”
Europe plans to finalize its gun directive later this year, Reuters reported.

University of California president, Janet Napolitano, announced that the nation’s first center dedicated to studying gun violence as a health issue, the University of California Firearm Violence Research Center, will launch on the UC Davis campus in Sacramento.
According to California Health Report, state lawmakers designated $5 million to launch the center. Napolitano said:
The state’s decision to provide public funding for a center to study firearm violence — the first of its kind in the nation — demonstrates great leadership by the state and presents a unique opportunity for the University of California to be at the forefront of researching a growing public health issue.
