It doesn't matter if it's all us wussie Americans that screw personal responsibility up. It's the law of this land that inciting, provocative, and offensive speech have limited to no coverage under the First Amendment.
I'd say it's clear she incited him.
Words have power and they have weight. They are persuasive and they are manipulative. It isn't about "not allowing yourself to be incited". Words prompted us, even incited us to revolt against England. Words have had a big part in inspiring and motivating us, too. (Why else have those "go out and git 'em" speeches before games?)
Then there's advertising where the right word is agonized over so that it sends the correct connotation to the targeted market.
I'm not sure why this idea of "we didn't really follow the Constitution until recently" or words to that effect, came from. The Constitution has been discussed, debated, amended, and amended again and again, and serves as the foundation to our Country. Traditionally, one of the differences of Republicans and Democrats is how they interpret it. The Republicans believe in strict, literal interpretation. The Dems believe in intent behind the words.
Because of this it's been argued over (by whatever parties there was at the time), since it was written, and its spirit and its words have been followed, also, since then.

In the weeks before he took his own life in 2014, Conrad Roy III was troubled, desperate to stop the pain. At times, he seemed to think that suicide was the answer, but wasn’t sure he wanted to die.
His indecision frustrated his girlfriend, Michelle Carter, who prosecutors say committed involuntary manslaughter by pressuring Roy, 18, to kill himself.
“I don’t think I have it in me,” Roy texted Carter one week before police found him dead in his pickup truck in a Fairhaven parking lot.
“I knew it,” Carter, 17, responded.
“I’m too scared,” Roy wrote. “You’re right. I don’t have it in me.”
On Thursday in Bristol Juvenile Court, prosecutors sought to portray Carter as a manipulative bully who recklessly goaded Roy into killing himself. On the third day of Carter’s trial, prosecutors zeroed in on a series of disturbing text messages exchanged in the days before Roy’s death.
“Are you gonna do it tonight?” Carter asked on July 3.
“I’m gonna try,” Roy responded.
“How hard are you gonna try?” she asked.
“Hard,” he said.
Carter continued to press the teenager, asking how he planned to take his life. When he said he didn’t know, she told him he wasn’t serious about it.
“How bad do you want it because if you want it bad, you should succeed,” she said to him.
Roy, of Mattapoisett, killed himself July 12 by inhaling a deadly dose of carbon monoxide generated by a gasoline-powered water pump that he had installed in his truck.
Carter’s lawyer, Joseph P. Cataldo, said the text messages did not tell the full story, and said he will file a motion on Friday asking Juvenile Court Judge Lawrence Moniz to issue a finding of not guilty due to insufficient evidence. Moniz is serving as fact-finder in the jury-waived trial. Carter faces up to 20 years in prison if convicted.
Over three days, prosecutors painted Carter as an attention-starved teenager who was desperate to improve her social standing, even by being seen as the “grieving girlfriend.”
Carter’s lawyers have said that Roy was a troubled teen who had attempted suicide multiple times. Carter had tried to help Roy by sending information on hospitals and mental health services, they said.
Carter had issues of her own. She struggled with an eating disorder, self-inflicted pain, and suicidal thoughts, she wrote to her peers in text messages.
For months, she and Roy discussed various ways of committing suicide, the level of pain one might endure, and the likelihood that the attempt would be successful, according to text messages presented in court Thursday. Carter eventually became annoyed that Roy hadn’t followed through.
“So it didn’t work?” she texted him. “You said you wanted this bad. I knew you weren’t going to try hard. I feel like such an idiot . . . You lied about the whole thing. You said you were gonna go to the woods, I thought you really wanted to die. But apparently you don’t. I feel played and stupid.”
After Roy tried to overdose on Nyquil and Tylenol, Carter scolded him for “purposefully” taking too little, and suggested he take 10 doses of Benadryl and a bottle of Tylenol. When he expressed reservations, she told him to “Hang yourself, jump off a building, stab yourself. I don’t know. There’s lots of ways.”
Two days later, Roy wrote her “How was your day?”
Carter responded: “When are you doing it?”
When police found Roy, his skin had turned “cherry red” and the carbon monoxide levels in his blood had reached 71 percent, Dr. Faryl Sandler, a state medical examiner, testified on Thursday.
Sandler said a person exposed to carbon monoxide would begin coughing within two minutes and lapse into unconsciousness after 13 minutes. A person typically dies after 20 minutes of exposure.
Carter told her peers that she listened over the phone as Roy died, and that she never notified authorities or his family. She told one friend that she could have stopped him, “but I told him to get back in the car.”

I understand your opinion and it is a slippery slope, but......
Involuntary manslaughter is the unintended killing of a person while committing a crime, or acting in a reckless or negligent manner.
I'm not sure it was involuntary and at best she was reckless in her actions and that's being kind.
He obviously had some problems and instead of telling someone, she chose to push him towards stepping off that cliff.
I can't even imagine what kind of person would do that.

Reckless disregard for your fellow human thru your actions or inaction is a crime.

That court was the Massachusetts Supreme Court.

That court was the Massachusetts Supreme Court.

Two things there, the hot coffee thing isn't an accident..it's negligence (on behalf of the toss pot spilling it for not taking common sense precautions) .
Second if I was negligent enough to spill coffee on myself...I would accept the responsibility for it.

The due process system is completely broken too, public defenders who have ridiculous case loads and spend barely anytime on each case, District attorneys trying to make a name for themselves at innocent peoples expense by offering plea deals to "score" results...while scared citizens sign because they can't afford a "real" defense and the choice is sign for 5yrs or face 25 to life...
Due process is a fantasy.

Don't get me wrong, I see your point....to a point. But, she did wrong, either way you slice it.
Well no, she didn't do anything but "talk"...last time I checked we had a 1st amendment...if some weak idiot does something to themselves because another person told them to, then it's 100% on the idiot.
Again I understand you Americans don't understand the concept of personal responsibility.
If you assist or talk somebody into killing themselves, OR provide them with the tools and resources to kill themselves, you CAN be charged with Involuntary Manslaughter.
While few states have "Pro-Death" laws, which will allow a person that wishes to die be given the right to a "Doctor-Assisted Suicide", if you live in one of the many states with laws against such practice, aiding the death of another is a criminal charge.
1st Amendment, or not, the 10th Amendment allows the States power to pass their own laws regarding such acts, which supercede Federal Law.
So, even IF Federal Law protects her right to speech, it does NOT protect her from facing consequences of a law written within the State she resides in.
I had to go through police questioning, during Tyler's investigation into his death, by the police chief of my township, a county sheriff, as well as a detective from a neighboring township that was called in to assist in the investigation.
