ROCKVILLE — Democrats in Montgomery County are crying foul over a Republican plan to close two early-voting sites, calling the proposal an attempt at "voter suppression" they vow to fight in Annapolis.

The dust-up in Maryland's most populous county could portend partisan conflict in other jurisdictions because every election board in Maryland now has a GOP majority after Republican Larry Hogan became governor this year.

The Montgomery fight broke out after the county election board voted 3-2 along party lines last month to close early-voting sites in populous Burtonsville and Bethesda-Chevy Chase and open new ones in the less densely inhabited areas of Brookeville and Potomac. The board chairman says the move was aimed at bringing "geographic diversity" to the nine county locations where voters can cast ballots before Election Day.

Democrats say the new sites are in more GOP-friendly communities with fewer minority voters.

That’s not surprising when you consider how egregious North Carolina’s policies have been.

First, North Carolina passed HB 589, which eliminated early voting entirely, eliminated same-day registration, and set up onerous ID requirements. That law affected more than 1.2 million people: 900,000 people utilized early voting in 2012, 130,000 used same-day registration in 2008, and more than 200,000 registered voters don’t have driver’s licenses. By way of comparison, Barack Obama won the state by 15,000 votes in 2008, and Mitt Romney won by 117,000 in 2012.

In July, the Fourth Circuit Court of Appeals struck down HB 589, going out of its way to note the racist nature of the law. The state’s general assembly had “requested data on the use, by race, of a number of voting practices,” wrote the court. And then, “Upon receipt of the race data, the General Assembly enacted legislation that restricted voting and registration in five different ways, all of which disproportionately affected African Americans.”

With HB 589 struck down in such damning terms, one might have thought that early voting would be fully restored. Instead, based on the earlier law that required “at least one” polling place open for early voting, Republican-controlled boards of elections in those 17 counties closed all but one early voting site per county. In other words, the barest legal minimum.

The lines were so long because Republican election officials in Phoenix’s Maricopa County, the largest in the state, reduced the number of polling places by 70 percent from 2012 to 2016, from 200 to just 60—one polling place per 21,000 registered voters. Previously, Maricopa County would have needed federal approval to reduce the number of polling sites, because Arizona was one of 16 states where jurisdictions with a long history of discrimination had to submit their voting changes under Section 5 of the Voting Rights Act. This part of the VRA blocked 3,000 discriminatory voting changes from 1965 to 2013. That changed when the Supreme Court gutted the law in the June 2013 Shelby County v. Holder decision.

The polling place reductions in Maricopa County were a glaring example of a disturbing trend. The Leadership Conference for Civil Rights surveyed 381 of the 800 counties previously covered by Section 5 where polling place information was available in 2012 or 2014 and found there are 868 fewer places to cast a ballot in 2016 in these areas. “Out of the 381 counties in our study, 165 of them—43 percent—have reduced voting locations,” says the important new report.

The 2016 presidential contest was awash with charges that the fix was in: Republican Donald Trump repeatedly claimed that the election was rigged against him, while Democrats have accused the Russians of stacking the odds in Trump’s favor.

Less attention was paid to manipulation that occurred not during the presidential race, but before it — in the drawing of lines for hundreds of U.S. and state legislative seats. The result, according to an Associated Press analysis: Republicans had a real advantage.

The AP scrutinized the outcomes of all 435 U.S. House races and about 4,700 state House and Assembly seats up for election last year using a new statistical method of calculating partisan advantage. It’s designed to detect cases in which one party may have won, widened or retained its grip on power through political gerrymandering.

The analysis found four times as many states with Republican-skewed state House or Assembly districts than Democratic ones. Among the two dozen most populated states that determine the vast majority of Congress, there were nearly three times as many with Republican-tilted U.S. House districts.

Traditional battlegrounds such as Michigan, North Carolina, Pennsylvania, Wisconsin, Florida and Virginia were among those with significant Republican advantages in their U.S. or state House races. All had districts drawn by Republicans after the last Census in 2010.

The AP analysis also found that Republicans won as many as 22 additional U.S. House seats over what would have been expected based on the average vote share in congressional districts across the country. That helped provide the GOP with a comfortable majority over Democrats instead of a narrow one.

Republicans held several advantages heading into the 2016 election. They had more incumbents, which carried weight even in a year of “outsider” candidates. Republicans also had a geographical advantage because their voters were spread more widely across suburban and rural America instead of being highly concentrated, as Democrats generally are, in big cities.

Yet the data suggest that even if Democrats had turned out in larger numbers, their chances of substantial legislative gains were limited by gerrymandering.

“The outcome was already cooked in, if you will, because of the way the districts were drawn,” said John McGlennon, a longtime professor of government and public policy at the College of William & Mary in Virginia who ran unsuccessfully for Congress as a Democrat in the 1980s.

A separate statistical analysis conducted for AP by the Princeton University Gerrymandering Project found that the extreme Republican advantages in some states were no fluke. The Republican edge in Michigan’s state House districts had only a 1-in-16,000 probability of occurring by chance; in Wisconsin’s Assembly districts, there was a mere 1-in-60,000 likelihood of it happening randomly, the analysis found.

The AP’s findings are similar to recent ones from the Brennan Center for Justice at the New York University School of Law, which used three statistical tests to analyze the 2012-2016 congressional elections. Its report found a persistent Republican advantage and “clear evidence that aggressive gerrymandering is distorting the nation’s congressional maps,” posing a “threat to democracy.” The Brennan Center did not analyze state legislative elections.

A research group in New Jersey has taken a fresh look at postelection polling data and concluded that the number of noncitizens voting illegally in U.S. elections is likely far greater than previous estimates.
As many as 5.7 million noncitizens may have voted in the 2008 election, which put Barack Obama in the White House.
The research organization Just Facts, a widely cited, independent think tank led by self-described conservatives and libertarians, revealed its number-crunching in a report on national immigration.
Just Facts President James D. Agresti and his team looked at data from an extensive Harvard/YouGov study that every two years questions a sample size of tens of thousands of voters. Some acknowledge they are noncitizens and are thus ineligible to vote.
Just Facts’ conclusions confront both sides in the illegal voting debate: those who say it happens a lot and those who say the problem nonexistent.
In one camp, there are groundbreaking studies by professors at Old Dominion University in Virginia who attempted to compile scientifically derived illegal voting numbers using the Harvard data, called the Cooperative Congressional Election Study.
