Big cases, retirement rumors as Supreme Court nears finish

WASHINGTON (AP) — The Supreme Court enters its final week of work before a long summer hiatus with action expected on the Trump administration's travel ban and a decision due in a separation of church and state case that arises from a Missouri church playground.

The biggest news of all, though, would be if Justice Anthony Kennedy were to use the court's last public session on Monday to announce his retirement.

To be sure, Kennedy has given no public sign that he will retire this year and give President Donald Trump his second high court pick in the first months of his administration. Kennedy's departure would allow conservatives to take firm control of the court.

But Kennedy turns 81 next month and has been on the court for nearly 30 years. Several of his former law clerks have said they think he is contemplating stepping down in the next year or so. Kennedy and his clerks were gathering over the weekend for a reunion that was pushed up a year and helped spark talk he might be leaving the court.

"Soon we'll know if rumors of Kennedy's retirement are accurate," one former Kennedy clerk, George Washington University law professor Orin Kerr, said on Twitter Friday.

When the justices take the bench Monday, they are expected to decide the case of Trinity Lutheran Church of Columbia, Missouri, which was excluded from a state grant program to pay for soft surfaces on playgrounds run by not-for-profit groups. The case is being closely watched by advocates of school vouchers, who hope the court will make it easier to use state money to pay for private, religious schooling in states that now prohibit it.

Missouri has since changed its policy under Republican Gov. Eric Greitens so that churches may now apply for the money.

Also expected in the next few days, though there's no deadline by which the court must decide, is a ruling on whether to allow the administration to immediately enforce a 90-day ban on visitors from six mostly Muslim countries.

Justice Neil Gorsuch, Trump's first Supreme Court nominee, could play a pivotal role in both the travel ban and church playground cases.

In all, six cases that were argued between November and April remain undecided. Three of those, all involving immigrants or foreigners, were heard by an eight-justice court, before Gorsuch joined the bench in April.

If the eight justices are evenly divided, those cases could be argued a second time in the fall, with Gorsuch available to provide the tie-breaking vote.

Former State Dept And CIA Employee Arrested, Charged With Federal Espionage

A former State Department employee was arrested Thursday and charged with espionage for allegedly transmitting Top Secret and Secret documents to a Chinese government agent, according to an affidavit filed with the U.S. District Court in Alexandria, VA.

Kevin Mallory, 60, of Leesburg is a self-employed consultant who speaks fluent Chinese. Court filings show that Mallory was an Army veteran who worked as a special agent for U.S. State Department’s Diplomatic Security Service from 1987 to 1990. Since then, Mallory has worked for various government agencies and defense contractors, maintaining a Top Secret security clearance. The Washington Post reports that Mallory was also an employee of the CIA.

Mallory faces life in prison under the federal Espionage Act, and could qualify for the death penalty if certain conditions are met.

According to court filings, Mallory traveled to Shanghai in April and was stopped by Customs agents at O’Hare Airport in Chicago after failing to report $16,500 in cash in his carry-on bags. A month later, FBI agents interviewed Mallory – who told them that he met with two people from a Chinese think tank that he now suspects were Chinese intelligence agents.

The suspected operatives gave Mallory a “special communications device” to securely transmit documents, which he claimed was only used to transmit two unclassified “white papers” on U.S. policy matters.

However, when FBI forensics searched the device, they found several other documents which Mallory believed to have been deleted, according to the affidavit. One message from Mallory to the suspected Chinese agent read “your object is to gain information, and my object is to be paid.” The Chinese agent’s response was reportedly “my current object is to make sure your security and try to reimburse you.”

Upon further analysis of the device, investigators found four classified documents – three of which were designated as Top Secret. According to the affidavit, Mallory was asked why some of the information at the top and bottom of certain pages was redacted – to which the alleged U.S. spy responded that it was to conceal the “Top Secret” designation so that “Unless read in detail, it appeared like a simple note,” along with an assurance that the information was valuable.

Mallory appeared in court on Thursday wearing a gray tank top and black athletic shorts, and requested a court-appointed attorney. He was ordered held pending a Friday afternoon detention hearing.

President Trump’s claims of illegal voting in the presidential election have been given further support by a new study by an independent think tank.

Just Facts’ analysis looked again at a Harvard/YouGov study conducted in the wake of the 2008 election, which surveyed 32,000 people about their voting habits. The Washington Times, which first reported on Just Facts’ study, notes that prior examinations of the data concluded that as few as 38,000 and as many as 2.8 million noncitizens voted in that election.

The study uses a lengthy series of calculations to recast the data, and also challenges a number of assumptions or alleged problems with the original study. For instance, it notes that the YouGov/Harvard data could also underestimate the number of non-citizens voting for a number of reasons as it uses Census data — which in turn underestimates the presence of illegal immigrants in the country.

“The Census Bureau counts only the number of non-citizens who respond to Census surveys, and some immigrants, especially unauthorized ones, avoid such surveys out of fear of exposing their immigration status,” the study says.

The Times reports that the YouGov data also assumed that noncitizens never misidentified themselves and citizens, something which Agresti believes to be false.

Just Facts’ study found that the number of non-citizens voting in 2008 was between 594,000 and 5.7 million. The study also concluded that between 1.2 and 3.6 million voted in the 2012 election.

If these numbers were the same or larger in the 2016 election, it could potentially account for Hillary Clinton’s lead in the popular vote — as President Trump has claimed.

In 2016, President Trump comfortably won the Electoral College vote — but Democrats and Clinton herself have taken unusual solace in the fact that she won the popular vote, and some Democrats have even used it to imply that Trump is somehow an illegitimate president.

Trump has, in turn, claimed that he won the popular vote if the number of those who voted illegally were excluded.

Tax season may be over, but next year’s taxes will be due before we know it—and at least 1.4 million Americans won’t know that their Social Security numbers are being used by illegal aliens. An Internal Revenue Service report that this is roughly the number of illegal aliens who are impersonating citizens when it comes to file taxes. To make things more maddening, they’re not allowed to work with the Department of Homeland Security on finding the identities of these people. Stephen Dinan at The Washington Times had more:

Most illegal immigrants who pay taxes have stolen someone else’s legal identity, and the IRS doesn’t do a very good job of letting those American citizens and legal immigrants know they’re being impersonated, the tax agency’s inspector general said in a new report released Thursday.

“Cases of employment identity theft can cause significant burden to innocent taxpayers, including the incorrect computation of taxes based on income that does not belong to them,” said J. Russell George, the inspector general.

It’s long been a conundrum in the federal government.

The IRS knows of 2.4 million people a year who file taxes using an Individual Taxpayer Identification Number, which is generally given out to immigrants who aren’t authorized to work. But the IRS is not allowed to talk with Homeland Security to help agents identify who and where those taxpayers are.

The migrants file their forms with their ITINs, but the W-2 forms they submit show valid Social Security numbers that they fraudulently gave to their employer to clear an initial work authorization check.

A staggering 87 percent of forms filed online using ITINs showed income credited to a Social Security number. More than half of forms filed by paper also showed that same fraudulent behavior.

WASHINGTON – German police recently raided the homes of 36 people accused of writing “hateful” posts on social media, with most of the raids targeting right-wing individuals.

Thirty-three of the raids concerned “politically motivated right-wing incitement,” while only two raids targeted people accused of left-wing extremist content. One of the raids targeted someone accused of making threats based on sexual orientation, according to the New York Times.

“Our free society must not allow a climate of fear, threat, criminal violence and violence either on the street or on the internet,” said Holger Münch, president of the Federal Criminal Police Office.

According to German law, social media users face up to five years in prison for “inciting racial hatred,” even if no physical violence is committed.

“Meanwhile, Islamists mow down people with cars and trucks at Christmas markets in Germany,” said Paul Nehlen, who recently announced he will challenge House Speaker Paul Ryan in Wisconsin’s 1st congressional district primary in 2018.

“It’s madness. German authorities are backing their own citizens into a corner with these types of draconian measures. When did Germany become Cuba, jailing people for political dissent? I’ve heard some of the never-Trumper crowd in the U.S. and in Europe refer to German Chancellor Angela Merkel as the new leader of the free world. I wonder how those jailed German citizens living under Merkel’s jack-boot feel about her ‘free-world leadership.'”

This week, a similar situation arose in Sussex, a county in southeast England. A man who posted “hateful” comments on Facebook was sentenced to 20 months of prison for each of the eight counts of “publishing threatening written material intending to stir up religious hatred against Muslims” with which he was charged.

“I hope the sentence handed down by the court on Friday acts as a deterrent to others and sends a reassuring message to those who may be directly targeted or are more widely affected by people’s use of social media to spread messages of fear and hate,” said Sussex Police Hate Crime Sgt. Peter Allan in a statement.

“I encourage people who witness such content, to report it to the provider of the social media platform, but such reports can also be made to us online.”

Supporters of the Islamic terror group Hezbollah called for the annihilation of Israel at a public rally in London during the same week,but were not approached by police.

Simon Johnson of the Jewish Leadership Council blasted law enforcement for the apparent double standard.

“I am convinced we’ve been caught in a bit of a civil service paralysis. … Now that we’ve suffered terrible terrorist outrages in this country – surely now is the time to be able to ban the flag of Hezbollah.”

Among Democrat “leaders” in California, Maxine Waters has a reputation for being not just a raving lunatic, but also completely devoid of class.

Waters, who makes Nancy Pelosi seem lucid and decent, could be described as “unhinged” on her best days.

Now, Waters has taken yet another shot at President Trump, telling a crowd that the president should be “dragged…to impeachment” for supporting the new healthcare bill.

In reference to the recent removal of protesters from Senate Majority Leader Mitch McConnell’s office, in which several people were dragged away by security, Waters claimed “…the only person who should be dragged anywhere is Trump…”

One of Waters’ signature rallying cries is “impeach 45,” and she has become known for an obsession with impeaching our president.

Yet again, Democrats prove themselves to be unwilling to cooperate with the rest of America, and are instead little more than obstructionists; their childish behavior and vitriolic rhetoric has only gotten worse, and has greatly harmed their party.

Rep. Maxine Waters (D-CA) taunted President Donald Trump on Friday, saying he should be “dragged… to impeachment” for supporting Senate Majority Leader Mitch McConnell’s (R-KY) healthcare bill.

As Breitbart News reported, Waters said at the rally:

He is not my president. He is not your president. He lies. He cheats. He’s a bully. He disrespects us all. If he thinks he can mess with the LGBT community, he better look at what happened right here in West Hollywood. You deny, you disrespect, and you will find that there are people who have the courage to organize and to take back whatever needs to be taken back. We resist this president because he stands for the worst of everything. And guess what, I know that people may not quite be ready. I know some are a little hesitant. I know some are saying I’m not so sure, Maxine, that what you are saying is the right thing, but I’m saying, impeach 45. Impeach 45.

And at last month’s Center for American Progress’s Ideas Conference, Waters told the audience that impeachment is not out of reach.

Waters also vowed to accuse to accuse Republicans of being “not patriotic” if they opposed Trump’s impeachment.

“Instead of disabled people in wheelchairs, the only person who should be dragged anywhere is Trump – down the hall, to impeachment,” she tweeted, referencing the protesters who were dragged from McConnell’s office while protesting the bill.

Maxine “Get Ready for Impeachment” Waters has been one of the most vocal advocates for impeachment.

She has led numerous “impeach 45” chants at various rallies, most recently at the annual LA Pride Parade and Resist March two weeks ago.

Rioter Gives Reasons For Riots/Violence ‘Rich People Got All This Money And They Not Trying To Give Us None”

Nobody has accused the rioters and protesters of Milwaukee of being too bright, and 24-year-old Orlandus Jackson takes that thought to a whole new level.

Jackson was interviewed by TMJ4, and was asked what was going through his mind when he heard about the police involved shooting of a black man who was armed with a stolen firearm, and the violent protests that followed.

Jackson says,

“It’s sad, because, you know, this is what happen because they not helping the black community.
Like, you know, the rich people, they got all this money, and they not, like, you know, trying to give us none.”

So what we have learned from one of the Milwaukee protesters so far, is that the reason there is looting in the communities, is because the rich people have “all this money,” and they are not trying to give the looters any.

Isn’t there a major political party, in America right now, that is pushing the notion of there being two Americas. An America of the rich, where all the money is, and then an America of the poor, where people can’t get ahead because of the rich?

It almost sounds like Jackson is buying into the Socialist and Democratic Parties’ narratives of class warfare.

Jackson then goes on to comment on the police involved shooting in Milwaukee:

“It’s sad, it’s like, and, you know police… it’s just crazy…”

Wow! So deep.

Jackson was asked what he thought about the looters in the area, who were using the death of a black man to justify destroying people’s livelihoods.

“I heard from a neighbor, they say, like, you know, like, someone got ‘killt’ on Sherman and Burleigh, and I was like, ‘What?’
Then me and my mom, you know, we drove over here and seen what happened.”

So… in Milwaukee, there are people who hear about a person being killed, have no information about the situation, and decide to grab their mom to visit the scene of the murder.

“And it’s pretty sad, really, what black people gotta go through.”

The saddest part about all of this is actually that there are individuals who think Jackson’s incoherent and nonsensical statements actually make sense.

An Internal Revenue Service report that this is roughly the number of illegal aliens who are impersonating citizens when it comes to file taxes. To make things more maddening, they’re not allowed to work with the Department of Homeland Security on finding the identities of these people. Stephen Dinan at The Washington Times had more:

Most illegal immigrants who pay taxes have stolen someone else’s legal identity, and the IRS doesn’t do a very good job of letting those American citizens and legal immigrants know they’re being impersonated, the tax agency’s inspector general said in a new report released Thursday.

“Cases of employment identity theft can cause significant burden to innocent taxpayers, including the incorrect computation of taxes based on income that does not belong to them,” said J. Russell George, the inspector general.

It’s long been a conundrum in the federal government.

The IRS knows of 2.4 million people a year who file taxes using an Individual Taxpayer Identification Number, which is generally given out to immigrants who aren’t authorized to work. But the IRS is not allowed to talk with Homeland Security to help agents identify who and where those taxpayers are.

The migrants file their forms with their ITINs, but the W-2 forms they submit show valid Social Security numbers that they fraudulently gave to their employer to clear an initial work authorization check.

A staggering 87 percent of forms filed online using ITINs showed income credited to a Social Security number. More than half of forms filed by paper also showed that same fraudulent behavior.

Three CNN Employees Resign Over Retracted Story on Russia Ties

Three CNN employees have handed in their resignation over a retracted story linking President Trump to Russia, the network announced Monday.

Thomas Frank, who wrote the story in question; Eric Lichtblau, an editor in the unit; and Lex Haris, who oversaw the unit, have all left CNN.

“In the aftermath of the retraction of a story published on CNN.com, CNN has accepted the resignation of the employees involved in the story’s publication,” a network spokesperson said in a statement Monday.

On Thursday, CNN investigative reporter Thomas Frank published a report involving an investigation of a Russian investment fund with possible ties to several Trump associates.

According to CNN, an internal investigation found that “some standard editorial processes were not followed when the article was published.”

Citing a single unnamed source, the story reported that Congress was investigating a “Russian investment fund with ties to Trump officials.”

CNN explained Monday that “these types of stories” usually would go through several departments, including fact-checkers, journalism standards experts and lawyers.

But the network says there was a “breakdown in editorial workflow” which “disturbed the CNN executives who learned about it.”

The network’s investigative unit was told during a meeting on Monday that the retraction did not necessarily mean the facts of the story wrong. But, rather, “the story wasn’t solid enough to publish as-is,” according to one of the people briefed on the investigation.

The story, which only appeared on the network’s site, was quickly disputed on Friday, as one of the people mentioned in the story — Trump ally Anthony Scaramucci — took issue with Frank’s reporting, insisting he “did nothing wrong.”

“Once it was determined that editorial processes were not followed, CNN deleted the story from CNN.com,” the network said Friday on its site. “Soon thereafter, the story was officially retracted and replaced with an editor’s note.”

The piece “did not meet CNN’s editorial standards and has been retracted,” the note said. “Links to the story have been disabled.”

The editor’s note also added an apology to Scaramucci.

“CNN did the right thing. Classy move. Apology accepted,” Scaramucci tweeted the next morning. “Everyone makes mistakes. Moving on.”

Haris, Lichtblau and Frank had a solid reputation among their colleagues.

Frank worked as reporter for USA Today and Newsday before joining CNN. Lichtblau is a former New York Times Pulitzer-Prize winning reporter. And Haris was the executive editor of CNN Investigates.

“On Friday, CNN retracted a story published by my team. As Executive Editor of that team, I have resigned,” Haris said in a statement. “I’ve been with CNN since 2001, and am sure about one thing: This is a news organization that prizes accuracy and fairness above all else. I am leaving, but will carry those principles wherever I go.”

Nancy Pelosi Dismisses Democrats Calling For Her Removal

House Minority Leader Nancy Pelosi appeared on “CBS This Morning” Monday where she was greeted with a video package of Democratic congressmen calling for her ouster.

Rep. Tim Ryan (D-Ohio) even called Pelosi more toxic than Donald Trump.

Ouch. When that many politicians are calling for a leader’s removal, perhaps the leader in question should address their concerns. But moonbat Pelosi did no such thing. She simply dismissed them all.

Pelosi clearly seems to believe that she’s the last hope for the Democratic Party now that Clinton has been pushed into exile. But in reality, she’s the John McCain of the Democratic Party: old, senile, and unpopular. It’s time for her to hang it up – we’d all appreciate it.

The Democrats have become nothing but OBSTRUCTIONISTS, all they do is delay and complain. President Obama did NOTHING after being informed in August about Russian meddling. There is no collusion & no obstruction — I should be given an apology!

"The reason that President Obama did NOTHING about Russia after being notified by the CIA of meddling is that he expected Clinton would win ... and did not want to 'rock the boat.' He didn't 'choke,' he colluded or obstructed, and it did the Dems and Crooked Hillary no good," Trump wrote.

"The real story is that President Obama did NOTHING after being informed in August about Russian meddling. With 4 months looking at Russia ... under a magnifying glass, they have zero 'tapes' of T people colluding. There is no collusion & no obstruction. I should be given apology!" he wrote on Twitter.

It was unclear who Trump was demanding an apology from or who he was accusing Obama of colluding with.

White House Press Secretary Sean Spicer said on Monday that the Obama administration's actions on Russia raise questions about the former president's motivations.
"They have been very clear, they've been playing this card about blaming Trump and Russia," Spicer said during an off-camera briefing at the White House. "And yet at the same time, they were the ones who, according to this report, knew about it and didn't take any action."
"So the question is, if they didn't take any action, does that make them complicit? I think there are a lot of questions that need to get answered about who knew what and when," Spicer said.
Trump has often expressed deep frustration over accusations that individuals in his orbit colluded with Russia during the election and assertions that he may have tried to personally influence the FBI's probe into the matter.
Last week, two of the nation's top intelligence officials told special counsel Robert Mueller's team and Senate investigators, in separate meetings, that Trump suggested they say publicly there was no collusion between his campaign and the Russians, according to multiple sources. Director of National Intelligence Dan Coats and National Security Agency Director Adm. Mike Rogers described their interactions with the President about the Russia investigation as uncomfortable but said they did not believe the President gave them orders to interfere, according to multiple sources familiar with their accounts.

Monday's series of tweets comes after Trump spent the weekend attacking the Obama administration over new reporting from The Washington Post that linked interference in last year's election directly to Russian President Vladimir Putin and revealed political considerations that may have allowed Moscow to avoid paying a significant price for an attempt to manipulate the US election on an unprecedented scale.
The Post said the Obama administration felt its hands were tied when Russian hacking first came to light because it did not want to be accused of interfering in an already turbulent campaign. At the time, Trump was claiming publicly that the election was rigged against him.
In a tweet Saturday, Trump wrote: "Since the Obama Administration was told way before the 2016 Election that the Russians were meddling, why no action? Focus on them, not T!"
Trump also criticized Obama in an interview that was broadcast on "Fox and Friends" on Sunday.

"It's an amazing thing. To me -- in other words, the question is, if he had the information, why didn't he do something about it?" Trump said, apparently seizing on a quote in the Post report that indicated that many Obama administration officials now believe that their own response to Russian hacking was insufficient.
"I feel like we sort of choked," one former senior Obama aide told the Post, referring to the administration's decision to impose sanctions and insert cyberweapons inside Russia's critical infrastructure that could be activated at a future point rather than launch more extreme retaliatory measures.
Trump's criticism of Obama comes as questions remain about whether the White House intends to take any muscular action to punish the Kremlin or to shore up US electoral defenses.

Trump: Hillary Clinton and Democratic Party 'colluded' against Sanders
Trump has repeatedly claimed that the Russian hacking accusations, validated by US intelligence agencies, and allegations of collusion between his campaign and Russians are a "hoax" perpetrated by Democrats upset about the party's nominee, Hillary Clinton, losing the election.
But now Trump seems to be finally acknowledging that Russia did play a role in the election.
Last week, White House spokesman Sean Spicer told reporters that he had not had a chance to sit down with the President to ask him whether he agreed with his intelligence agencies that Russia did actually interfere in the election. Pushed on Friday, Spicer said that Trump stood by a comment in January this year when he said: "I think it was Russia." Spicer also said Trump was concerned about election interference by "any actor."

A former Obama White House official called the Trump administration's attacks "a transparent effort to distract from the terrible impact of their ACA repeal bill."
"This situation was taken extremely seriously," the official added, defending Obama's decision to raise the issue directly with President Putin, direct a comprehensive intelligence review, shut down two Russian compounds, sanction nine Russian entities and individuals, and eject 35 Russian diplomats from the country.
